The James Holmes and the Aurora theatre shooting case. There are many pieces of evidence in this case that could be looked at as someone who committed a premeditated shooting and someone who was in fact insane. Ultimately the insanity plea did not work in James Holmes favor but it did extend what would have already been a long death penalty case. Some key pieces of evidence were highly controversial in the fact that there was arguing over whether or not it should be allowed in court. Reid were shown to the court as evidence. In the series of videos Holmes shares his thoughts and feelings to Dr. Reid. These videos really show that something was very wrong mentally wit James Holmes and could be used by the defense to try to help with the insanity plea. The prosecutors could use this evidence to just prove that he was not insane but did actually have a mental disorder that didn’t affect his ability to know what he was doing was wrong. The book shows James Holmes thought process and planning which shows premeditation. Premeditation is not usually something an insane person is capable of. If the notebook did end up in court I would try to prove that the notebook was full of thing that only an insane person would do and think of trying to convince the jury that James was in fact insane and not normal. I would use the videos of him in his jail cell to show the court that something is wrong with him helping further to prove insanity. The most important argument of my case would be the events earlier in his life. James Holmes did not live a normal childhood. He attempted suicide at a young age. He would see things starting at a young age that (although not actually there but they were in his mind) involved loud noises throughout the night and people fighting and killing each other with weapons and firearms. I think a stronger focus on James Holmes younger years could have helped out the defense a great deal and they didn’t really seem to focus on it that much during the
When Paul Bieger was the lawyer for the defense he had to imply that Frank Mansion was crazy or insane because the other three defense charges could not be used in this case. But if he could imply that Frank Mansion was insane during the time when he committed the crime there was a chance that Paul Bieger could win the case. But Paul had to prove that the reason Bieger went insane during that time was because he just heard news about his wife getting raped by Quill. Frank was not able to constraint or anything other than getting payback for what Quill did. On the prosecutor side the lawyer Mitch Lodwick had to prove that during the time Mr. Mansion had time to deliberate planning, premeditation, or malice.
My client Calvin Smith is not guilty due to reason of insanity. Mr. Smith is schizophrenic, considering the fact that he was able to hear ersatz noises, he has anosognosia that results in him denying his mental illness, as well as schizophrenics are known to have voices that tell them to do certain things- such as harm others, and themselves. With this information, the allegation is correct, he did murder the man. Although, he is not in the right mind to know it was wrong. This is because Calvin Smith is schizophrenic.
He allowed for the DNA to be reviewed and they found the two pieces of evidence that supposedly were connecting her and him did not exist and were contaminated sources. The eye witness as well that had claimed to see Amanda and Raffaele outside the cottage the night of the murder was an inadmissible source. On the last day of the trial the judge asked for statements by Amanda and Raffaele that they did not commit the murder. They both gave their statements passionately and emotionally. He ordered these two individuals after four years be let go.
Back in 1975, there was a major case called, Payton V. New York. Theodore Payton was suspected of murdering a gas station manager, they found evidence within his home that connected him with the crime. What caused the problem was the fact New York had a law that allowed unwarranted searches if the person was a suspect. Based off the oral argument presented by Oyez, the police said it didn't count as the evidence because it was in public view when entering the home. It had to be appealed before it was determined as unconstitutional.

Even Darrow defended someone who was arrested with murder, Mr. Patrick Eugene Prendergast, and he pleaded for insanity, his whole family was known to be crazy, but he was still given capital punishment, which is the death sentence. The reason the trial with Leopold and Loeb was so important was because it was one of the first cases in Illinois where the insanity plea worked. It also helped show the importance of how capital punishment is seen more as revenge, rather than “transformative justice”. In other words, the death sentence is really only a way to get revenge and not a way you can help a person. After this case and many more cases, Illinois has finally prohibited the death sentence in 2011.
Sherlock Holmes Imagine a dark and smelly room that is really crowded, just because you broke the law and did something dumb, well that’s the consequences when you do something wrong. The countess lost her jewel because somebody took it, and then later somebody ended up finding it in a goose. In my opinion Sherlock Holmes did the wrong thing by letting those nasty criminals go.

He received commands from his neighbor’s dog apparently. Psychosis is when you have hallucinations or an unclear tell of what is reality and fantasy. David Berkowitz did not know that the dog wasn’t commanding him to murder or kill anyone which is a sign of psychosis. Holmes differed from David Berkowitz because Holmes did not have hallucinations or believe anyone was commanding him to do anything. Holmes was stable enough to know what he was doing and even wrote a memoir on what his crimes
No medical evidence was ever collected or shown to prove that the crime ever took place. On the night after the assault, Mayella Ewell was never seen be a doctor. She was never examined to prove that Tom Robinson did anything to her. Mayella stated that she was beaten that night, so she should have gone to the doctor to get checked out. There is no proof of any crime, so there should not have been a guilty verdict.
The issue of the case was to determine Dahmer’s mental stability, and whether he suffered from a personality disorder/illness. The defense argued that Dahmer was driven to his hateful acts as a result of an obsession that he could not control due to a mental disease. Through numerous trials, expert doctors and psychiatrists were brought in to testify and diagnose Dahmer. On both sides, there were doctors that diagnose Dahmer in correlation to their argument. For example, the final defense expert diagnosed Dahmer with schizophrenia, borderline personality disorder, alcohol dependency, etc.
Paul Hunter opened my eyes to how important ethics are to journalists. He added context to some challenges taught in class and also informed me of new ones. One of the most shocking things Hunter mentioned was how a journalist’s notebook can be used as evidence against them in a case. He stated if an interviewee decides to sue and there are negative doodles and/or names about them in the notebook, that could be taken as bias against the plaintiff. I chose this because I never thought a notebook could potentially be used against me rather than for me.

In the Sherlock Holmes story there was a man named Ryder. Ryder stole a gem from a lady, later Ryder went to his sisters house, at his sisters house she has geese, and Ryder wanted a goose to eat for thanksgiving supper, he picked a goose who had a long black stripe down its back. Ryder chose that one because he needed to know that goose from the other geese.
The definition of a hero is a person that has special achievements, abilities, or personal qualities (Dictionary.com). However, the definition of an antihero is someone who lacks the nobility of mind and spirit, and a life or attitude marked by action and spirit. Sherlock Holmes is a hero for these reasons. First, Sherlock uses his sense of logic and observation to solve many mysteries that others seem to have difficulties with. He also has notable characteristics in behavior, as he is quiet about his theories and thoughts until he is sure he has cracked the case.
