The death penalty should be used nationally in America. It has the potenetial to help America in its current economic condition, and help with the fear culture in todays present society, & has little to no cons. In today society there is a economic system in place that has many out of work or people struggling to make ends meat to supply for their family. Many of wich could greatly benefit from the help of the government with situations such as food, medical aid, housing, and schoolarships to schools to be provided education so they can be more of an adiqeit and beneficial useful member of our society, but with this same system people who have commited some of the most hanous crimes imaginable to our society receive free food, housing, clothing, …show more content…
One of these issues is how it effects societies beliefes and morals. In todays society religions rules such as: “thou shall not kill” which causes problems for some that believe that life is sacerate. Though with this if someone is put to death its most likely for murder which is a sin. Also there is a major moral concern that the wrong person will be held responsible for a crime they didn’t commit. Being sentenced to an irreversible punishment, but the error rate in felony cases is only .5% (Bohm, R. M. & Haley, K. N., 2014). Some people consider the death penalty a violation of the eighth amendment. The eighth amendment protects everyone from excessive bail and more importantly protecting from cruel and unusual punishment, but if this is really a violation of the eighth amendment is arguable. Many people believe being sentenced to life in jail is just as or even more cruel as being sentenced to death. Plus many courts have ruled it constitutional. Such as in the 2015 excecution of Clayton Cockett were his excicution was “botched” and the family tried to sue was ruled constitutional with the ruling saying “ lethal injection process [doesn’t] qualify as cruel and
Facts of the Case/Question: A jury found Gregg guilty of armed robbery and murder, then sentenced him to death. During appeal, the Georgia Supreme Court confirmed the death sentence, except it could not be used because of the robbery. Gregg challenged his death sentence for murder by claiming that his capital sentence was a "cruel and unusual" punishment that violated the Eighth and Fourteenth Amendments. This case also settled several other cases.

The lethal injection executions illustrates a constitutional violation of the branch 's overreach as described by the 8th amendment due to its cases bring either successful in the execution or providing sufferable pain to death row inmates. One of the current problems in the Judicial branch is the use of lethal injection towards execution sessions. Lethal injection is an injection that is administered for the purpose of euthanasia and capital punishment. There are two methods of lethal injection today, one using a three drug protocol and the 2nd being the large dose of barbiturate. Lethal injection is used for capital punishment as it follows the 8th amendment we have today.
The Rules of rights from the 8th Amendment ‘’Unless this right to bail before trial is preserved the presumption of innocence secured only after centuries of struggle, would lose its meaning. The U.S supreme court has ruled that this is a Amendment cruel and unusual punishment cause also applies to the states. The court concluded that the death penalty as a punishment for murder does not itself
The Eight Amendment Excessive bail shall not be required, nor excessive fines imposed, nor cruel, and unusual punishments inflicted. Previously the Eight Amendment was formed very differently from what we know today. The death penalty has been one of the most discussed topics since it first became a part of society. It is a constant disagreement to prove or challenge whether or not the death penalty is a cruel and unusual punishment which would then now go against the eighth amendment. The death penalty is a suitable sentence, while going through the history, and different methods.
The death penalty is and has been one of the biggest debates around the world. The united states are ranked 5th in the world for executions. Americans are stuck about 50/50 for being for the death penalty. I believe a good compromise is to only execute a human on rare occasions and to make sure you have strong evidence against the
The way the death penalty process starts is with the type of crime committed, and the decision being reached by a court that the crime is punishable by death. Once the offender has been sentenced to the death penalty they are given the opportunity for an appeal or are mandated to appeal depending on the state. Offenders can appeal the decisions of the court on state and federal levels in an effort to change their death sentence and with the average time on death row being a decade death penalty inmates have more than enough time to pursue appeals. Although, if the offender is to be executed it will be done humanely by means lethal injection unless the offender chooses another state approved method of execution. The death penalty is not cruel and unusual punishment the offender goes through a process that sentences them and immediately gives the time and opportunity to appeal and if executed the right to not be

It’s Not working out. By:Taija Jones. The 8th amendment says “Excessive bail shall not be required, Nor excessive fines imposed, Nor cruel and unusual punishments inflicted” . With that being said if the 8th amendment applies for cruel punishments of death penalties then why is it still happening.
Is the death penalty cruel and unusual punishment? I think that this can be explained through the way the inmates are executed. Firing squad, lethal injection, hanging, gas chamber, and electrocution are
Death Penalty According to the 2010 Gallup Poll, 64% of the United State of America are supporting the death penalty, I as an American am part of that 36% that is against it. I do not believe that we as human being should determine whether another person should live or die. A second reason that I am against the death penalty is for the reason that the accused person could be innocent and normally the accused person only has one court presentation and is only judged by the judge not a jury of their peer, and is sent to death row where they pay for a crime that they haven’t done. My final reason that i do not believe that the death penalty should count as a punishment for the American people is because, a person that has done a massive massacre shouldn’t just be able to leave the world just like that without paying and suffering for what they have done, Or should the death punishment continue as it is for it has a great benefit to us as citizens of the United States.
Capital Punishment, better known as the death penalty. This topic may be one of the most debated in the United States. Many of those who support the death penalty also believe in the famous saying “an eye for an eye”. This is just another way for them to justify their support for this law and to ignore the fact that they have blood, of innocent people executed under this law, on their hands. Throughout the years some states have chosen to step away from using this system, as I believe it has no actual benefits.
