Congress Have Too Much Power Under The Constitution Of 1787

As seen in the earlier paper, the Constitution and the Articles of Confederation played a significant role in the development and progression of the United States of America. Although the Federalist were involved in the transformation as well, one must also have an insight as what was occurring during the time of the switch. As one knows now, both documents relate to one another, and were intended to service America and protect the people’s freedom by imposing the law. The Constitution replaced the Articles of Confederation, because it was not stable, it limited the power of Congress, and limited the National government.

In the summer of 1787, the new government of the United States of America realized that there was a problem with their current government. Many parts of the constitution guards against tyranny because the new constitution has checks and balances, the separation of powers and federalism. The original problem that was called to the attention of the old government was the articles of confederation were very weak, and they needed to create a strong central government. According to document A, a quote by James Madison states, “The different governments will control each other, at the same time that each will controlled by itself.” The central and state government will work together, which shows federalism.

The framers of the United States constitution decided to give more power to the federal government than the state government, the framers did this because they didn’t want to create a government with tyranny in it, they also did this to create new ideas for the states. The framers did this because they simply didn’t want the government to have complete control over the people, instead the framers wanted to have the people to have a government just not a complete power one. The framers wanted the people to be able to choose what kind of government they had, what kind of leader they had, they wanted to the people to have a choice. Some problems that the articles of confederation had is that that the articles limited the government significantly.

The Articles of Confederation created a confederation in the United States. A confederation is a government in which the state government, not national, has dominant power. The leaders of the new nation feared that a strong, centralized government would lead to tyrannical monarchy like the British government. So the Founding Fathers established a confederation where there was no president nor Supreme court, and a Congress with limited power. But the existence of a weak congress led to an ineffective national government.

The Articles of Confederation and Perpetual Union was the first governing document of the United States. The idea of a central and coordinated effort for the colonies (or states, as they had become) was deemed necessary and beneficial in light of the Revolutionary War. The environment in which it was written, however, ensured its lim-ited power and in effect created a weak system of government. The Articles fostered many achievements, such as creating a central body to conduct foreign policy, estab-lishment of the departments of war, treasury and marine, as well as the national postal system. Following the American Revolution, America was divided into two political groups: the federalists and the anti-federalists. Both parties believed the United states future was in the best interest of the new nation. While the anti-federalists believed in power to the individual states, the federalists believed in a strong central government to body the nation. Prior to 1789, the Articles of Confederation is what held the nation together, despite the immense problems that arose from it. The document was formed in order to equally divide powers in America.

After the Articles of Confederation failed because they failed to give enough power to the national government and congress, our founding father’s needed to reflect on its flaws for a new system to be set in place. Their new creation, our Constitution, was then set into place, and was created from a basis of the Articles of Confederation. The Articles of Confederation directly influence the Constitution by its failure by changing some of the responsibilities of the federal and state governments. The Articles of Confederation gave too much power to the states, and the Constitution changed that.

The Articles of Confederation had left the central government weak and ineffectual, prompting the call for the Constitutional Convention . As James Madison argued in Federalist No. 10, "The friend of popular governments never finds himself so much alarmed for their character and fate, as when he contemplates their propensity to this dangerous vice.” To address this issue, the Constitution established a system of checks and balances between the three branches of government, ensuring that no single branch would dominate . The separation of powers across the executive, legislative, and judicial branches, along with checks and balances, made it difficult for any one branch to dominate the others. The Constitution further divided power in the legislature through bicameralism in Congress.

We all had those moments when we all hated the congress for passing a bill that destroyed their dreams or the president for only who they were or what their stance on certain things, however have you ever thought who really calls the shots, the President or the Congress? Like sure, it would make sense if the President has most of the power, while Congress has some or vice versa. Although when it comes to certain things, the Congress has more power over the situation. McCubbins, they state that the president must possess impressive resources upon which to draw.

After declaring of independence from Britain in 1777, the representatives, who participated the Constitutional Congress meetings in 1774, formed together to create the Congress. Power within the Congress believed that creating an official document, a constitution specifically, will create a timeless guide for a beneficial and successful government system for the United States. Not only will that document bring peace between all of the current thirteen-states, but for also the future of America. The first constitution that was officially agreed on was the Articles of Confederation. the Article of Confederation, however, was not as successful as many had thought during the first time it was written.

The Articles of Confederation were a document seen as the “first” constitution of the United States. This document granted the new national government power to control the military, declare war, and create treaties between the states. However, the Articles had holes in it considering the government did not have the power to tax, create laws without at least nine states’ approval, or change the Articles of Confederation without a unanimous vote. This means that the country soon fell into debt and petty arguments between state, the new government had no control. It was time for a change.

Between July 1775 and November 1777, there was the drafting of the Articles of Confederation which followed a slow state ratification process, delaying ratification of the Articles of Confederation until the 1st March of 1781. Congress later on convened and held conferences until the 4th day of March in 1789 after which the Federal government took over within the confines of the constitution. Understanding that the Articles of Confederation did not stay in place for too long, we cannot overlook their contribution in terms of paving way for a longer lasting Constitution. These articles of Confederation had their similarities to the Constitution as well as differences; most of these differences thus constitute the Articles’ weaknesses as shall be discussed below. The Articles of Confederation came to relate so much to the Constitution and would later be adopted.

The Articles of Confederation was an agreement among the thirteen original states of the United States that served as the first constitution. The Articles had first been introduced by Richard Henry Lee in the Second Continental Congress. Although the Articles of Confederation has made its contributions throughout history, the Articles, however, did not last very long and had been proven inadequate from the very start. I agree with this statement based on the examples and analysis of the Constitution I will soon provide. The Articles of Confederation were written during a time when the American people feared a strong national government.

In one hand, the Articles of Confederation had a weak central government, differing form the strong central government in the Constitution. The Constitution’s government had a structure of three different branches; the legislative, executive, and judicial branch; unlike the Articles of Confederation that had no structure whatsoever. The Articles of Confederation had many problems like, the poor international trade, poor foreign relations and a weak economy in contrast to the Constitution that only had one problem, the struggle over the ratification. the Articles of Confederation achieved the Northwest Ordinance and the Northwest Territory and according to a history website, the Constitution achieved that we had a system of checks and balances, that we had a bill of rights, and, eventually, the survival of a bloody civil war intact. Lastly, the Constitution had three compromises: the Great Compromise, the Three-Fifths Compromise and the Slave Trade compromise.

The Articles of Confederation was the first Constitution in the newly independent USA, founded by the continental congress, with purposes of uniting the colonies after the revolutionary war. Founded by the continental congress, the government power under the articles was limited due to fear of monarchy (like Britain) ,which left an abundance of power into the state's governments control. The articles of confederation proved to be weak and unable of supporting an effective government in terms of many things. The Articles created problems for the new nation economically speaking. However, the articles weren’t completely a failure, and found success in dealing with western lands.
