Civil Rights Vs. Civil Liberties

I. Introduction The United States is founded on the concept of Liberty. As expressed in the Constitution, all United States citizens are entitled to the rights of life, liberty, and the pursuit of happiness. These values have been endlessly challenged throughout history in an attempt to determine where freedom should end and where government regulation might begin.

When our founding fathers first created the Constitution it was found unworkable and had to have some changes before the ratification. In that process people began to have some differences such as the Federalist saw that the enhanced Constitution alone would protect all basic human rights. While Antifederalist saw that we needed an extra addition to the document that would genuinely give the basic rights, liberties, and limit the government from denouncing these rights and liberties from the people. The Bill of Rights was a necessary addition that has and will continue to protect the people from injustice in the government with the help of the Supreme Court.

The Bill of Rights also changed the government and transformed it for the better. The government is the way it is because of the Philadelphia Convention. The delegates knew that America would evolve and adjust so they offered some protection. They didn’t want the constitution to hold back the country from developing, so they inserted a law in Article Five stating that the government could make changes or amendments to the constitution. This crucial decision has benefited generations.

Slavery in The Civil War The American civil war from 1861 to 1865 divided many people in the United States, even turning brother against brother. There were also great amounts of bloodshed and was one of the bloodiest wars in the US and left a heritage of brief and bitterness. And the basis of this war, slavery, slavery is usually very cruel and has been around since early man. Their were two sides to this war, the North and the south.

Civil liberties are freedoms stated in the Bill of rights that protect the people from unreasonable government interference while Civil rights guarantees protection by the government to protect an individual from another. When the Bills of Rights was made it was not created as a list of guaranteed rights for citizens but simply made to state what things the government was not allowed to interfere with (Steve Mount).Although some may say that the U.S constitution did not need to include a specific listing of civil rights and liberties because it was unnecessary, I would have to disagree. The Bill of Rights is in my opinion not specific enough to protect the rights of the people the way it should. It simply just states what cannot be interfered

Civil Right were redefined in the century after the Civil War through many occasions mainly: The Reconstruction Amendments, Reconstruction Plans, Lynching by Race, and The Civil Rights Act of 1964. Most of these occasions were made for the sake and protection of slaves after Civil War. Rights were granted after the Civil War to the slaves and many other privileges and other facilities that the whites had. During Reconstruction, three amendments to the Constitution were made in an effort to establish equality for black Americans.

Civil Liberties protect everyone from an overbearing government while Civil Rights protect certain groups or races. Also Civil Rights are based of a democratic government since they represent everyone that lives under that government while Civil Liberties come from a limited government where the people have momentous power and the government has certain restrictions over its power. 4 In 1833 in the court case of Barron v. Baltimore the court said that the Bill of Rights applied to the federal government, not to the states. They also said that every 4 American has dual citizenship.

We’re able to express our political beliefs without being fearful that we might get sent to jail. Without this amendment, we wouldn 't be able to speak up for ourselves against the government whenever we

The Civil Rights was the rise of action that enforced the rights for freedom, equality, the fight against discrimination and more. The people during this time were treated unequal and were discouraged so Americans around the country took a stand. Behind this cause was the power of the strong leaders that convinced people to take their side, the right side. The speeches by these leaders took a huge and powerful effect on these individuals by the way they styled their words. This style is called rhetoric.

Chapter 4 of the book We the People talks about Civil Liberties, this chapter mainly talks about the Rights that were placed in the Constitution (not in the Bill of Rights), it also talks about the Bill of Rights and it describes the rights protected by the Bill of Rights. It also talks about specific rights that work close together with the Bill of Rights and Amendments rights. One of the first Amendments that is described in great detail is Freedom of Speech and Religion. The first Amendment protects US citizens right to talk about almost any topic in the United States. I said almost any topic because there are some forms of speech that aren’t protected by the First Amendment (these forms of speech can be limited or prohibited), some of the forms of speech that aren’t protected by the First Amendment are Fighting Words and Hate Speech, Student Speech, Libel and Slander speech.

Civil rights refers to fighting for equal rights between blacks and whites. It is an important part of history. From time to time, people have been fighting for civil rights for blacks in whites in the mid 1900’s. In fact, Bloody Sunday was probably one of the most important events to have an impact on history for civil rights. Everyday, people struggle to be treated equally and civil rights make it possible for everyone black or white to be treated equally.

Freedom has been the center of American ideals since the United States gained independence from Great Britain. To protect these ideals, the Founding Fathers created the Bill of Rights; which contains the first ten amendments to the Constitution. The document grants American citizens their basic rights and freedoms. The First Amendment guarantees the freedom of speech, freedom of religion, freedom of assembly, freedom of the press and the right to petition the government without retribution. It directly states: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the

This included things like the discrimination of gender, race, color, or national origin. If we didn’t have civil rights, our nation could be a much darker place than it is right now. The Civil Rights Acts of 1964 & 1968 were some of the most progressive events in the Civil Rights movement. They gave equal opportunities in housing, employment, schooling and even went as far as to ban segregation in all public places. The Civil Rights Act of 1964 made segregation illegal in public schools and public spaces and made employment discrimination criminal. The Civil Rights Act of 1968 mostly consisted of the Housing Discrimination Act and the Indian Civil Rights Act. They made discrimination in housing matters like renting, selling and buying illegal and established civil rights for Indians and how they would govern themselves.
