8th Amendment The Eighth Amendment is a very surprisingly important amendment that is commonly forgotten. This amendment was necessary, and more shockingly needed than expected. It was against the need and use for excessive bails or cruel and unusual punishment. Many people have experienced the need for this law in the past and had a big impact on cases nationwide. It has saved lives from the mistakes made before this amendment. The judge has the opportunity to assign legal punishments and penalties, but the purpose of this amendment was too protect them from the preposterous punishments like the excessive use of the death penalty for cases not necessary. The history of the amendment actually dates back to the roots of the amendment which was used in the Bill of Rights in 1689. The new amendment made in 1791 was a replica in a way of what was in the Bill of Rights. The practical use for this amendment was obviously needed because the punishments used back in those early times was much more aggressive and cruel. The death rate that came with the amount of these punishments was out of hand, and obviously now we don’t see any cruel punishments like they used to. There are still cruel punishments but the amendment made them more suppressed and reduced the number of them drastically. The Amendment was a safeguard for the American people. The Eighth Amendment was created to prohibit cruel punishments that the colonists would receive from the British. The British brought colonists over to an unfair trial and then received punishment that sometimes would be death. The writers of the wanted to make sure that the colonists received the fair trial and fair punishment they deserve. The Eight Amendment was ratified in December 5, 1791 as a part of the Bill of Rights. The Eighth Amendment has not been changed since the ratification in 1791.
In the late 1700’s, James Madison wrote the first Ten Amendments that are listed in the United States Constitution. An amendment, and justice is ultimately what keeps the citizenry of the society safe each and every day, if anything. Although we are aware that ever state in America has not ratified the 8th amendment and that’s something that needs to change because if you think about it although the death penalty is a cheap option and easier way to get rid of criminals who could commit more crimes. You must take into the fact that no life should be taken, and that all lives matter even if serious crimes have been committed by that person. If the state has not ratified the amendment and refuses to then they should have certain policies, restrictions, etc. and be sure to follow
The Importance of the 1st Amendment In 1787 our founding fathers assembled the constitution of the United States of America. 6th Amendment I personally find that out of all the amendments the most important one is the 6th amendment. Reason being that it is crucial in aiding the judicial process from wrongly persecuting innocent people and it allows our democratic process to continue without preventing innocent people for taking the fall while punishing those who harm it. It keeps justice in check, keeping laws in line and rulings to be fair. The 6th amendment helps the defendants have an attorney when they are unable to afford one.
