Legislative Branch Research Paper

The legislative branch is one of the most powerful branches of government, in charge of making and enacting laws. Article one consist of ten sections, in which they describe the powers granted by the constitution to Congress. Section One states that the legislative powers of the Constitution are vested in the Congress, which is composed of the House and Senate. This section is crucial because it is the foundation and structure for the entire legislative body of the United States.

The members of the senate and house of representatives are named congress. Senate - 2 members of each state are elected. This means that there are 100 senators. A senator’s term is 6 years and there are no term limits. House of Representatives - There are 435 House of Representative members.

Congress has the authority to declare war, which has only been done 11 times. Congress decides to use this power when they deem it necessary for the safety of the United States citizens and other reasons. Another important power that Congress has is the power to tax. It is used in order to pay debts like war debts, to provide for the common Defense and the General Welfare of the United States. Also, Congress has the power to establish post offices.

Legislative Branch in my government is unicameral legislative which only consists of a House of Representatives. The House of Representative elected thirty-five members that are divided among the states that have to be elected every two years but you had to follow by guidelines which are: Have to be at least twenty-five years old Is a U.S. Citizen for at least seven years Has to be a resident of that represents that state The House of Representatives forms a Congress which the constitution allows the Congress to pass legislation and to declare war. The One thing that makes my legislation different is not having a senate which goes in depth of determination of the bills. The determination of the bills allows them to look very deep into what they think the bills should be like which makes the senate slows down the process of the bills.

One becoming a senate must be: over 30 years old, been a US citizen for 9 years, and length of the term is 6 years. There is no limit on how many terms one can serve in either or. From looking at the qualifications, it is fascinating that Representatives have more relaxed qualifications compared to the Senate. These qualifications and the total number of members allowed could be a way to promote sociological representation, representation of group through similar race, gender, ethnicity, and religion as the group.

The Congress is the “first branch” or “legislative branch” of the Federal Government that represent the American people and makes the nations laws. It also shares power with the executive branch, led by the president, and the judicial branch. The Judicial Branch is the highest body of the Supreme Court of the United States. The Congress has two parts of the United States: U.S Senate and the U.S House of Representatives. In total there are 100 U.S Senators and 435 U.S Representatives.

Revising the US Senate... The US Senate is the least representative legislative and worst branch of a government body in the democratic world. An ever shrinking minority of voters has the power to obstruct policies favored by the majority of the American people. From the 18th century to the present, the ratio of large- to small-state populations has grown from 19-to-1 to 66-to-1.

It also is responsible for maintaining the military. All legislative power in government is secured within congress meaning that it is the only branch that can make new laws and change existing laws. When trying to pass a bill, the president is able to veto the bill but congress has the power to override the president’s veto by two-thirds vote in the senate and the House of Representatives. Mann and Ornstein argue that the Legislative Branch is the most important branch of Congress. Each branch is given specific powers and responsibilities, many of which overlap. However, “it is clear, when push comes to shove, that Congress can trump the other two branches” (14). Congress struggles to keep its head above the water when communicating with the other branches. Congress, as one of the three coequal branches of government, is ascribed significant powers by the Constitution. All legislative power in the government is vested in Congress, meaning that it is the only part of the government that can make new laws or change existing laws. The President may veto bills Congress passes, but Congress may also override a veto by a two-thirds vote in both the Senate and the House of Representatives. Part of Congress 's exercise of legislative authority is the establishment of an annual budget for the government. To this end, Congress levies taxes and tariffs to provide funding for essential government services.

The Congress was created as “the first branch” of government. The Framers of the Constitution expected Congress to wield most of the nation government’s powers, including its most important ones like “power of the purse” and the ultimate authority to declare war. They understood that Congress was essential to sustaining federalism and maintaining the separation of powers (WDB 393). To be elected to the U.S. Congress, a person becomes a candidate by running in a primary election. Candidates need to form organizations of personal followings and win “their party’s” nomination simply by getting more primary votes than the next candidate.

The United States Congress has many roles such as making laws, implementing national policy and viewing over the other two branches of government. These are a couple of obligations the Congress has.

The Congress is the legislative branch apart from it there’s also the Executive branch and Judicial branch. The Congress is made up of two houses; the Senate and the House of Representatives together they make up Congress. The representatives are representing their people in their state and number representatives chosen are according to the population. The senate has each state sent two senators. They both try to help democratic, republicans, and the people with laws being made or decisions.

In addition to the powers previously listed, they also include, “the power to declare war, raise and support armed forces, organize the militia, grant citizenship, and establish post offices and courts” (69, Enumerated Powers). Lastly, Congress was given a power called the elastic clause. The elastic clause,”lets Congress stretch it powers… that Congress can make all laws “necessary and proper” to carrying out powers expressed in Article I” (69, Enumerated Powers). Some amendments that limit the legislative branch’s power is the 27th amendment. In the textbook, it states that it ,”Banned Congress from increasing its members’ salaries until after the next election” (88, Other Constitutional Amendments).
