The purpose of the Constitution was to establish a central government authorized to deal directly with individuals rather than states and to incorporate a system of checks and balances that would preserve the fundamental concepts contained in the Magna Carta, that is, to limit the power of the government. The first three articles of the Constitution establish the legislative, executive, and judicial branches of government and the country’s system of checks and balances. The balance of power was established vertically through the separation of power between the federal government and the states and laterally through the three branches. In the supremacy clause, the constitution declared itself the supreme law of the land. The U.S. Constitution
The articles of the constitution work to establish the branches of the federal government and describe what powers they have. The first three articles split up the branches of government. These branches are the Legislative, Executive, and Judicial. All three of the articles are to explain what the branch does. On the other hand, Article four talks about the relationships between states, and that is my favorite.
Ever heard of the Articles of Confederation? Thought not. That’s because within only 8 years of their ratification, they were gotten rid of. This was because, among other things, there were no courts, no national currency, and no taxes. So in May of 1787, 55 men gathered together in Philadelphia to come up with a better plan.
The first constitution of the United States was called the Articles of Confederation, ratified on March 1, 1781. These articles gave supreme power to the states, followed by a weak central government. The central government was unicameral, meaning there was no executive or judicial branch and all federal power came from Congress. Congress was made up of two to seven members per state and each state contributed one vote each. members Congress were appointed by state legislatures and held a term of one year.
“When the framers of the Constitution met in 1787, they set out to establish a political system that would protect liberty and place limits on government.” (Ginsberg, 28). In 1777, the Continental Congress acquired the first written constitution, the Articles of Confederation, for the United States, only to be replaced by the Constitution around ten years later, due to the weaknesses found in the Articles. Although the Articles were required in 1777, they were not ratified at that year, “it was not ratified by all the states until 1781.”(Ginsberg, 35). Under the Articles of Confederation, the states had more power than the central government.
The Constitution united the states in a more structured and governed body, while allowing the states to have some individually, and protected all rights of people specified in the Bill of Rights. The main fear in the constitution was that the central governing power in federal government would create a tyrant, something the colonists feared from their experience as being part of the British empire. Because of this, the founding fathers divided all the powers in the federal government into branches: the executive, legislative, and judicial. Each branch is in check with the others, and makes it extremely hard for the country to fall into
The original constitution of the United States was drafted for multiple reasons. Under the Articles of Confederation, the federal government was extremely weak. The individual states had more power than the federal government, and each of the states acted more like independent countries. Additionally, the Articles of Confederation did not distribute power well. The revised Constitution allowed for 3 branches of government, which divided federal power so that one branch could not become more powerful than another.
The Constitution will provide a governing body for the citizens along with basic rights; the Constitution would ensure liberty for the people, a balance spread among the government, the states and the people, suffrage, the right to secure private property, and equality through life, liberty and the pursuit of happiness. The power within the government would be separated into three branches (legislative, executive, and judicial) by the separation of powers, and a system of checks and balances would ensure that one branch would not overcome each other, and would rely on each other to enforce the law. The principles of the Constitution include: individual liberty, federalism, limited government, representative government, private property, the
The US Constitution is a document based on the US Federal government’s law and it presents legal checks and balance for the branches of government. The reasoning behind this system was to give an in depth set of values and guidelines for the American people. It is separated into three parts: The Articles, the Bill of Rights, and the changes and additions. The initial three articles are written to establish the responsibilities, powers, and balance each branch the federal government has.
