The First Constitution: The Articles Of Confederation

fter the Treaty of Paris formally ended the American Revolution and recognized the United States of America as an independent nation, the Founding Fathers were made responsible for creating a government for the United States of America. They initially founded the Articles of Confederation, a weak government, out of fear of a strong, powerful one like Great Britain. Shortly after, however, the Founding Fathers noticed that the Articles of Confederation were failing. An enduring issue that connects to this time period is the enduring issue of conflict because the weaknesses of the Articles of Confederation were the root cause of many conflicts between and in the states, as shown in Documents 1 and 2. Documents 1 and 2 both summarize the major flaws of the Articles of Confederation and the many conflicts they sparked.

The Articles of Confederation was written in 1777 by nearly the exact same people who would later go on to write the United States Constitution. This document was meant to unify the colonies to create a sufficient government. The Articles of Confederation’s focus was to ensure that the state and local government possessed the power throughout the colonies. However, the document failed the country due to the lack of a central government because the states did not want to reestablish the type of government that England had after the Revolutionary War. The lack of bigger government caused many problems that would make each state almost look like they’re were separate.

The framers of the United States constitution decided to give more power to the federal government than the state government, the framers did this because they didn’t want to create a government with tyranny in it, they also did this to create new ideas for the states. The framers did this because they simply didn’t want the government to have complete control over the people, instead the framers wanted to have the people to have a government just not a complete power one. The framers wanted the people to be able to choose what kind of government they had, what kind of leader they had, they wanted to the people to have a choice. Some problems that the articles of confederation had is that that the articles limited the government significantly.

The Articles of Confederation was written by Congress. Benjamin Franklin was the first to make up an article and to present it to Congress in July 1775, his draft was never fully considered. John Dickinson from Pennsylvania was the fourth to submit a draft for the Articles of Confederation. Dickinson’s third summit was presented to Congress.

The constitution claims to have a goal to “form a more perfect union” and “insure domestic tranquility” (Document 1). These were both issues under the Articles of Confederation, considering the 13 states were extremely separate and divided, each with the ability to make it’s own taxes, currency, and trade regulations. The period between the adoption of the Articles of Confederation in 1781 and the drafting of the new Constitution in 1787 was one of weakness, dissension and turmoil. Under the Articles of Confederation, no provisions were made for an executive branch to enforce the laws nor for a national court system to interpret them. A legislative Congress was the sole organ of the national government, but it had no power to force the states to do anything against their will. It could declare war and raise an army, but it could not force any state to meet its assigned quota for troops or for the arms and equipment needed to support them. It looked to the states for the income needed to finance its activities, but it could not punish a state for not contributing its share of the federal budget.

The Articles of Confederation and Perpetual Union were created to hold the United States of America together during times of war. In the Articles, the founding fathers granted most governmental powers to the states, leaving only those necessary for the war effort – primarily the declaration of war, the creation of peace treaties, and the conduction of foreign relations – to the federal government. In this system, individual states were given precedence over the entire nation – an aspect that led to its downfall after the Revolutionary War. The Articles of Confederation denied the federal government the ability to issue taxes and tariffs – a power so necessary to the new country’s success, and yet so feared by its forefathers. The Articles of Confederation is defined as the first written constitution of the United States which was ratified on March 1, 1781. I will be discussing the strengths and weakness interwoven in the articles of confederation which is comprised of terms agreed by the thirteen new states (Delaware, Pennsylvania, New Jersey, Georgia, Connecticut, Massachusetts, Maryland, South Carolina, New Hampshire, Virginia, New York, North Carolina, Rhode Island) To engage in a centralized form of government whilst each state retained the liberty of self-rule which encompasses "sovereignty, freedom and independence." The Articles of Confederation and the Constitution are two important documents in American history that established the foundation for the current system of government in the United States. While both documents aimed to establish a functioning government, they differ greatly in their approach to governance and the protection of individual liberties. The Articles of Confederation, adopted in 1777, were the first constitution of the United States and provided a framework for a loose confederation of states. Under the Articles, the central government was relatively weak and had limited powers, with the states retaining most of the power. The government had no power to regulate commerce, levy taxes, or enforce laws.

Most of the power, under the Articles, was given to the states, so they all went in different directions, in terms of their individual governments. As for Congress, it was given little authority or support, which led to the failure of almost every diplomatic relationship. The issues with the document was that the American Congress had limited power and couldn’t create specific laws that dealt with issues with foreign countries and the economy of the states because, under the document, they were considered unconstitutional. George Washington, the general of the American army during the Revolutionary War, believed “it [was] necessary to revise and amend the articles of confederation, I entertain no doubt; but what may be the consequences of such an attempt is doubtful. Yet something must be done, or the fabrick must fall, for it certainly is tottering,” after the hardships with supplies, training, and lack of “advanced” artillery him and his men had experienced during the winter at Valley Forge from 177 to 1778.

The Articles of Confederation was the first written constitution of the United States. Stemming from wartime urgency, its progress was slowed by fears of central authority and extensive land claims by states before was it was ratified on March 1, 1781. Under these articles, the states remained sovereign and independent, with Congress serving as the last resort on appeal of disputes. Congress was also given the authority to make treaties and alliances, maintain armed forces and coin money. However, the central government lacked the ability to levy taxes and regulate commerce, issues that led to the Constitutional Convention in 1787 for the creation of new federal laws.

The Articles of Confederation were a document seen as the “first” constitution of the United States. This document granted the new national government power to control the military, declare war, and create treaties between the states. However, the Articles had holes in it considering the government did not have the power to tax, create laws without at least nine states’ approval, or change the Articles of Confederation without a unanimous vote. This means that the country soon fell into debt and petty arguments between state, the new government had no control. It was time for a change.

The Articles of Confederation was an agreement among the thirteen original states of the United States that served as the first constitution. The Articles had first been introduced by Richard Henry Lee in the Second Continental Congress. Although the Articles of Confederation has made its contributions throughout history, the Articles, however, did not last very long and had been proven inadequate from the very start. I agree with this statement based on the examples and analysis of the Constitution I will soon provide. The Articles of Confederation were written during a time when the American people feared a strong national government.

The Articles of the Confederation was the first government constitution that the United States used, and, although there were strength like the Northwest Ordinance of 1787, there were major weaknesses of the Articles of the Confederation like the following: requiring 9 out of the 13 colonial votes from the representatives from different states to pass a law; having no executive and judicial branch; and the federal government being unable to impose tax revenue onto the states. Such flaws would eventually lead to the Constitution and the repeal of the articles, for the Constitution was a measure to fix the problems of the articles with a stronger government that allowed them to impose taxes and and implement new laws for a more effective government.
