What Causes Broken Congress

In The Broken Branch, Thomas E. Mann and Norman J. Ornstein offer a first hand and well-explained account of what is wrong in the United States Congress today, when and where the government started to let things slip, and how Congress can work to get back on track. Mann and Ornstein begin their book by discussing some of the history, events, and reasoning behind practices of today’s Congress. Not until chapter three in the book do they really get into the root cause of the problems facing Congress in today’s day in age. In chapter three, Mann and Ornestein detail that they began their political careers in Washington D.C. in 1969, at the peak of the dissatisfaction that citizens were feeling over the Vietnam War (47). The legislative branch is one of the most powerful branches of government, in charge of making and enacting laws. Article one consist of ten sections, in which they describe the powers granted by the constitution to Congress. Section One states that the legislative powers of the Constitution are vested in the Congress, which is composed of the House and Senate. This section is crucial because it is the foundation and structure for the entire legislative body of the United States.

The us constitution and the Articles of Confederation are similar but different in many ways. The articles of confederation line out the basic ideas of government and written in the US Constitution are the expanded ideas that make the United States Unique. The Articles of confederation #7 states that all of the United States of America have to vote for the ratification of one thing. This was established to keep silly laws/acts to the Articles of Confederation from being amended but as more important amendments had to ratified it became nearly impossible to have all of the state representatives vote together for the ratification of one thing.

Congress was only a legislative body. The laws that it wrote could not be directly enforced by Congress. This meant that the states could largely ignore demands sent out by Congress. Congress also had no control over many state economic decisions. For example, each state had its own currency and taxed each other’s goods.

Congressional gridlock is normal in todays society, the cause of it is the lack of congressional moderates. It is believed that disorganization of a government can have difficulty applying actions to policies. When there are different parties in the government there is bound to be limited power on someone’s end. Legislation action is believed to be a cause. This goes along with the struggle of balancing order and freedom.

The reason Congress is given this ability is because Congress has assumed the position in order to better do its job. In many cases the Supreme Court has had to decide whether the interference of Congressional actions were constitutional, in the majority of these court cases the outcome has benefited the federal government. For instance, the case over McCulloch v. Maryland Chief Justice, John Marshall, interpreted the Necessary and Proper Clause, by conveying that the federal government (Congress) has the ability, under Necessary and Proper clause “to find the great powers, to lay and collect taxes; to borrow money; to regulate commerce; to declare and conduct a war; and to raise and support armies and navies. The sword and the purse, all the external relations, and no inconsiderable portion of the industry of the nation are entrusted to its Government.”

Laws made by Congress were also commonly ignored. Since Congress left most of the power to the states, it could not force anybody to obey its laws. (98) Congress could enforce neither national nor international trade regulations. “Sometimes citizens imported goods from other countries and then refused to pay for them…Congress had no power to make laws regarding trade among states. States taxed goods going from one state to another.” (99) This caused many citizens to lose their jobs and disrupted many international trade agreements.

There are many differing views on the powers congress holds, and congress itself, one such point of view is on whether or not congressmen should have a limited number of terms they are capable of serving, similar to how the president is only capable of serving two terms, and whether or not it would benefit both the people and the government. Congress itself is the legislative branch of the federal government, and as such holds a large amount of authority and power, including putting laws into effect, declaring war, taxing, impeachment, and many other important duties that can be carries out only by congress. Furthermore, members of congress do not have limits on the amount of terms they are allowed to serve, only limits on the length of each term, for those in the house of representatives each term is two years, while in the senate, each term is six years long. There are many factors behind this poll because it is a common view of the majority of the American people that in many issues, Congress has become a puppet in the hands of the President against its true will. But it is one side of the picture because the other side of the picture will show us the different scenarios. Truly speaking, Congress is not an impartial body now. I do not agree with the statement because the congress has went down because of many presidencys failures and mistakes. Our government does not have much power and is not as strong because of many wrongdoings of legislatures and people in the white house. Some people say that our government is good, but in reality it isn’t. Many others countries have been offending us and doing stuff to out computers and technology and the U.S. does nothing about it. Many cops are killing people for no reason and the governmet doesn’t stop them because they keep on doing it.

The Senate and House of Representatives comprise the two chambers of the United States Congress.
