R. V. Bann - Verdict Rationale In the case of R. V. Bann, Bobbie Bann, the defendant, was charged with second-degree murder. Around the 14th day of June, the year 2015, in the City of Mariposa in the County of Missinaba, Mr.Bann committed second-degree murder on Fallon King, who was in the bathroom when she killed by gunshots. During the trial, it was a little confusing, the defense side was making objections almost the entire time, and it is a little difficult to follow, however, I did manage to found some evidence that indicates that Mr.Bann has murdered and caused the death of Ms. King. Bann does when he heard the scraping noise. It is a good point that might prove Mr. Bann has murdered Ms. King, that is if the judge had overruled at the time and let the crowns continue. Although the crowns didn’t get the chance to finish the question, it did make me think. According to Mr.Bann, he said he was just trying to protect his property and his loved ones, however, his action says otherwise. When Mr. Bann heard the noise, the first thing he did was not to check on Ms. King to see whether she was still safe and with him, instead, he went to grabbed his gun and went straight to the bathroom. The possible explanation for his action is he knew Ms.King was not in the bed but in the bathroom. He even said himself, that he felt Ms. King moving and turning on the bed beside him. The Fourth one is a doubt that the crowns put in my mind. It was about the possibility that the witnesses could be lying. According to Mr. Starr, after he heard the gunshots, soon he heard screaming, and according to Mr.Bann, it was him who screamed, after he smashes the door and saw Ms. King’s body, which takes place after quite a lot of time passed since the shoots. This means all the wounds on Fallon was caused by the same weapon --- Mr.Bann’s 9mm, this is the strongest evidence that shows he caused the death of Fallon. And then during the trial, the crowns did prove that Mr.Bann have a motive to murder Ms.King. The evidence support it is the slightly ripped birthday card. Mr.Bann have mentioned that he wanted Ms.King to move in with him for a very long time, and he is afraid that she rejects it. Mr.Bann could have shot Ms.King out of anger, anxiety or fear. From the damaged birthday card, we could image the regret and fear Mr.Bann felt after he murdered Ms.King. But I believe the jury did not get this point, because during the trial, the defense lawyer keep asking the police officer about is she know the gun can hold 11 ballets in total, one loaded one, and 10 in the cartridge case. I find this confusing, because, if there are 11 ballets, and four are fired, there should be 7 ballets left. But the gun has 6 ballets left, which means if there were 11, then there are 5 ballets been fired, but there is no fifth ballet find at the scene. I arrived at the Volupides residence on October 13th, 1982 at 1:15 a.m. When I arrived, Arthur was dead at the bottom of the stairs. If the narrator is guilty of premeditated murder, then many things can be held against him that could get him arrested. To begin with, he lied to the police when they asked him if anything was wrong. In this murder case our suspect, Queenie Volupides, claims that her husband Arthur slipped down the stairs and fell to his death. Prior to the incident Queenie and Arthur had an altercation and afterwards Queenie left the home to go to the country club and drink. At close to one, Queenie returned home to prepare for some friends that she had invited over for a few more drinks. When Queenie’s friends arrived at her home Queenie met them at the door and told them that Arthur died after he slipped down the stairs. Since Queenie’s friends were not there at the moment of Arthur’s death we have no witnesses besides Queenie herself.
