Have you ever wondered if a murder case has the same outcome as every other murder case? The answer to that question is no. The reason for this is because each case has different outcomes depending on certain topics throughout the trial. These topics include the trial setup, the evidence presented, the society attitude, and the important events that took place while the case was occurring. After comparing two different murder cases, the West Memphis Three trial and Casey Anthony trial, one can learn that the influences happening throughout the society and how well the evidence is presented will help predict the outcome of the case. The trial setup has a huge impact on how the information will be presented during each case. The West Memphis …show more content…
It helps persuade the jury to decide if the accused is guilty or innocent. The evidence that was provided during the West Memphis Three case was more of “it could be true” types of ideas instead of a direct path leading to one of the boys. Yes, some of the evidence was persuasive, but it could have been pointed to many different people in the city. Examples of the evidence that was used in the court case included: they wore black clothing, they were supposedly part of a satanic cult, they listened to heavy music, and a knife was found behind Jason Baldwin’s house. Some people throughout the city were also questioned about the boys, but they were untrusting …show more content…
These groups of people are influenced by the attitudes of each other and how they interact. The society can believe what they want and can be easily swayed to either side of the trial. This helps the jury think even deeper on what they believed really happened. The attitude towards each one of these cases were very similar, but they had different outcomes. During the West Memphis Three trial the society was against the three boys and believed they were the actual murders. They believed this right from the beginning of the trial without looking closer at the evidence. These boys were found as guilty until better technology and better professors got involved that influenced thousands of people that the three boys were actually innocent. During the Casey Anthony trial the media and people in the society were angered about the murder case and were against her, but there were also many people that believed she never did such a thing. In the end, Anthony was found
Casey Anthony was one of the only things people could talk about in 2008. Casey Anthony blew the news up about the killing of her daughter, the case lasted for about three years before the court finally reached a non- guilty verdict. The media and people all around America continued to speculate on reasons why they thought the verdict should have been guilty. After examining the case, two theories connect to the case. Casey Anthony has allowed me to further explore and examine all the theories so that I could explain the reasoning behind Anthony’s actions.
Caylee Anthony, a young two-year-old girl, of Orlando, Florida was last reported seen on June 16, 2008. Her grandmother, Cindy Anthony, reported her missing on July 15, 2008. This was almost a month after she was last seen. Caylee Anthony lived with her grandparents, George and Cindy Anthony, along with her mother, Casey Anthony. Cindy became suspicious of the whereabouts of her granddaughter after not seeing her for almost a month and her mother’s car having a strong odor of dead body.
Many people believe that Casey was guilty of the crime and that the jury made a mistake in acquitting her. Others believe that the prosecution did not present enough evidence to prove beyond a reasonable doubt that Casey was
The smell in the trunk of the car was tested and contained a large amount of chloroform and key compounds of human decomposition. Evidence is evidence but not all evidence is good, but the “smell of death” that was in the trunk could have been used as good evidence to the case. Why? Because they did not have any other good evidence to prove that she killed her daughter, but that one piece of evidence alone could have convicted her of murdering her daughter.
Prejudice is defined by a preconceived opinion about something that is not based off reason or actual experience. This injustice has always existed in society. Through means of racial inequality, hate, stereotypes and jurors wanting to take an easy road out of trials, it makes appearances in court trials and the justice system. I believe that through the similarities and differences within the trails of Jefferson in A Lesson Before Dying and Steven Avery seen through this real-world court case accurately demonstrate the unacceptable, unchanging prejudice present in the justice system.
In order to be convicted of a crime in the United States, one must be proven guilty beyond a reasonable doubt. In the case of the West Memphis Three, there was excessive doubt as to the guilt of the boys, but they were still incarcerated. This is another example in the history of this country of how people will make rash decisions contrary to morality and legality in response to
After a 10 and a half hour meeting, they absolved her on the charge of murder and only found Casey Anthony guilty of perjury. The verdict exasperated American society. America felt pity towards Casey and had no sympathy for her mother. Everyone who listened to the case all over the world was shocked by this verdict of the jury, all of the evidence, the surrounding the murder of the child was indicated only one person, the girl's mother, Casey therefore, this evidence was just enough for the jury to plead a guilty verdict. After this case, many americans believed that the justice system in America failed completely and In this case it was almost impossible to bring forward charges under articles regarding the death penalties It wasn’t optional to produce the first degree murder.
It is hard to stand against a group by yourself because in “12 Angry Men” Juror 8 is getting ganged up on, in “The Monsters are Due on Maple Street” Tommy is being called stupid by all the neighbors for having the opinion that he did, also in both of the stories the person who wasn’t going with the group was always the one to call out first. In “12 angry men” juror 8 is the only juror saying that the boy is innocent and everybody else is ganging up on him. Then they start to ask questions like why do you think he's innocent and he says I don’t know
The united states is one of the most empowered country’s from our economy, to our military, but like every other country we have our flaws. Our flaws are found in our judicial system. You can witness these flaws by watching the HBO series paradise lost, a documentary about the West Memphis three, a brutal killing of three West Memphis boys. This court case shows many flaws from the bias to the actual evidence the prosecution shows.
However, pretrial publicity has been shown the significantly affect the judgments jury members make about the defendant, which subsequently affects their interpretation of evidence and their overall verdicts. The biases brought about by pretrial publicity deny the defendant a trial by an impartial jury, a right guaranteed by the Sixth Amendment. By postponing the publicity of the case until after the trial has begun would still give the media their First Amendment right of reporting the details of the case and give the defendant his Sixth Amendment right of an impartial jury. Even if all pretrial publicity cannot be halted, defending attorneys can use strategies to mediate the effects of pretrial publicity. It is important to be aware of the effects pretrial publicity has on the judgments of jury members in order to ensure defendants rights are not violated.
Guilty or not guilty, all citizens deserve a thorough trial to defend their rights. Formulating coherent stories from events and circumstances almost cost a young boy his life. In Twelve Angry Men, 1957, a single juror did his duty to save the life of an 18 year old boy by allowing his mind to rationalize the cohesive information presented by the court and its witnesses. The juror’s name was Mr. Davis, he was initially the only one of 12 jurors to vote not guilty in reason that the young boy, sentenced with first degree murder, may be innocent. I am arguing that system 1 negatively affects the jurors opinion on the case and makes it difficult for Mr. Davis to convince the other jurors of reasonable doubt.
“I find it deeply upsetting when I see justice not being served. How do we as human beings deal with the unknown? The West Memphis Trial is a joke on so many different levels” - Atom Egoyan. The West Memphis Three case is one of the most famous trials ever as there was a documentary released covering the case. The documentary got nationwide attention and interest from celebrities like Johnny Depp, the most involved one of all.
The first layer the Wedding Cake Model of Criminal Justice are celebrated cases. These cases are directly in the sites of media outlets. This because of the celebrity involved with the case. These type of cases command a great deal of media attention. When the court systems are dealing with these types of cases, they have to go about them a certain way.
“There may be times when we are powerless to prevent injustice, but there must never be a time when we fail to protest”. - Elie Wiesel. The bias present due to race and because of that the injustice for Emmett Till. This trial is important because it wasn’t about the murder of Emmett Till, it was about the two sides of race between both parties when it shouldn’t have been like this. After Emmett Till wolf whistled at Roy Bryant’s wife Carolyn, Bryant and friends went to Moses Wright house.
Unfortunately, in this case the prosecution did a poor job on linking all evidence to Casey Anthony that proved she murdered her daughter. The prosecution ignored a single plain legitimate notion “Corpus Delicti” requirement and due to that failure of addressing it the jury was forced to give a “not guilty” verdict from the beginning of the
