I think that Amendment Eight is important because you have the right to bail, which is very useful in some cases and because if you do something that isn 't even that bad you will just probably get a warning and before this amendment you would probably get put in jail. It states on https://www.google.com/gws_rd=ssl#q=amendment+8+definition, “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.” This supports my answer because it says that that we now have the right to bail and we are free from cruel and unusual
•Explain what the amendment says (in plain English) – Search and seizure: the fourth amendment. This amendment prohibits officers and active members of the law to unlawfully search or enter a home or school without a search warrant; and even with a warrant you can only search where evidence might be found. If you are looking for a stolen car, you cannot check the kitchen cabinets the car won’t be there. If an area is improperly searched and something is found that cannot incriminate anyone, and is not allowed to be displayed in the court of law. •Explore what issues made it important for lawmakers in the Early Republic--important enough to add this amendment to the Constitution.
Upon reading the U.S. Constitution, Article I, Section 8 stood out for me. The reason being is that it was not contained in the Articles of Confederation. In Section 8, it says that Congress will have the power to impose and collect taxes. This was a step from the Articles of Confederation that they once followed. This was one of the many problems that they had.
The Importance of the 24th Amendment and Effects. The U.S. Constitution has been amended twenty-seven times since ratified on June 21, 1788. These Amendments have been crucial to the up-keeping of America and its constant changes. The most of important of which being the 24th Amendment, which protected voting rights from taxes. The 24th amendment reads as followed “The Twenty-fourth Amendment of the United States Constitution prohibits both Congress and the states from conditioning the right to vote in federal elections on payment of a poll tax or other types of tax”.
The 15th amendment is one of the most important not just when it was written and passed but also currently, especially with the hateful prick we have as a president. The 15th amendment was one step in the eyes of the government to give African American men the same rights as whites. The Civil war ended May 9, 1865 five years later the, on March 30, 1887, the 15th amendment was written. As much in favor as it is for African Americans is did not apply to woman of either race. Women in the eyes of the men in this time should stay uneducated and should not have a say in political things.
Capital punishment commonly referred to as the death sentence or penalty is a topic of widespread controversy. The question of whether capital punishment is “cruel and unusual” provokes questions about societal values and the philosophy behind punishments. As decreed in the Eighth Amendment of the United States Constitution it declares the use of “cruel and unusual” punishments is to be prohibited. With many execution methods such as lethal injection, electrocution, beheading, hanging, firing squads, and stoning, it sparks the question. Do these fall under the Eighth amendment?
The Constitution of the United States is the concrete platform that the nation is built upon which contains fundamental principles in which our nation is governed by. However, much of the Constitution is very ambiguous which leads to controversy in the court room. For example, the Eighth Amendment which states that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted” (Baltzell). The first part of the Eighth Amendment protects accused citizens of the United States from unreasonable and extreme amounts of bail that would prevent them from being released from pretrial containment and it also limits the amount of a fine that can be given to a convicted person (8th Amendment)(Kurt). The
The most important thing is that it simply provides citizens with the framework for our criminal legal systems. This Amendment is very important because it states American Citizens’ rights and what they are upheld to follow when they have been accused of a crime. This Amendment also prevents a defendant from sitting in prison longer than they are going to have too, which are using up other American tax dollars. I like this Amendment because it is impartial and without delay (unless for necessary reasoning). It does not give too much power to the jury nor the defendant.
The Eighth Amendment is all about punishment. In the Amendment it states, “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”, as well as allowing the Death Penalty. I believe this Amendment is right. Because of the fact that cruel and unusual punishment wouldn’t be fun, I believe the Death Penalty should be legal, and excessive fines would be crushing to our economy. Cruel and unusual punishment would not be fun.
All in all, the Eighth Amendment has undergone quite a revolution in the last century. Its significance in the dealings of criminal law are paralleled by law as it quite literally defines criminal law itself. Most, if not all, cases that deal with the civil rights of criminals, such as the vastly influential Miranda v. Arizona case, which introduced the obligation to police officers to read suspects their natural rights, would have never came about if it wasn 't for the case which changed the meaning of cruel and unusual. As time goes on, society as a whole will evolve, hopefully in a more peaceful manner, and as such the Eighth Amendment will evolve alongside society, keeping up with how the public opinion feels about certain things along the way. In the near future, things like the death penalty might become horrific tales of the past to be left just a bad memory, and in the far future, maybe even things like manual labour will be outlawed with the rise of automation making such labour unnecessary.
Even though the Westboro Baptist Church offends many people with their picketing and other demonstrations, I believe that the first amendment to the U.S. Constitution should continue to protect their right of performing these acts for two reasons. One, the first amendment already protects, in a sense, some of the actions the church performs, for example, the picketing of high school graduations and claiming perverts ran the schools. As unbelievable as it may sound, the first amendment allows them to say particular things like this because of what is known as the Sullivan Rule, which is a court guideline protecting inaccurate and harmful declarations against public officials as long as the claims were not known to be false at the time they
The convenient thing about this is that you can do as you please without the worry of the government trying to disrupt your peace. It also helps people of color feel protected from police officers who could be racist, and just want to go through their belongings to arrest them. Another advantage to this is that you don 't have to let police officers inside of your home if you don 't please to do so. However, the downside to this amendment is that valuable time to police officers is wasted since they have to wait for a search warrant to proceed with their job. Another downside is that if they do happen to search someone without a warrant and they find what they were looking for it won 't be able to be used as evidence against the
The Sixth Amendment is part of the United States Bill of Rights and its clauses are related to criminal prosecutions. It states that every defendant has the right of speedy and public trial, impartial jury, to be confronted with the witnesses against him and to choose such in his favor and to have the aid of a layer in his defense. The right to an attorney’s assistance has been focused on two main issues throughout its development – the right to counsel and the right to an effective counsel. When the Constitution was adopted, courts in Britain did not appoint lawyers to defendants charged with felonies, opposite to those who were accused of misdemeanors.
Amendment 3 impacts the people by allowing them to refuse or allow a soldier any shelter with their word. Amendment 8, “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.” Furthermore, this was written by James Madison. Nevertheless, this amendment impacts the people by not allowing one to be harmed once they’ve committed a
An amendment, and justice is ultimately what keeps the citizenry of the society safe each and every day, if anything. Although we are aware that ever state in America has not ratified the 8th amendment and that’s something that needs to change because if you think about it although the death penalty is a cheap option and easier way to get rid of criminals who could commit more crimes. You must take into the fact that no life should be taken, and that all lives matter even if serious crimes have been committed by that person. If the state has not ratified the amendment and refuses to then they should have certain policies, restrictions, etc. and be sure to follow
6th Amendment I personally find that out of all the amendments the most important one is the 6th amendment. Reason being that it is crucial in aiding the judicial process from wrongly persecuting innocent people and it allows our democratic process to continue without preventing innocent people for taking the fall while punishing those who harm it. It keeps justice in check, keeping laws in line and rulings to be fair. The 6th amendment helps the defendants have an attorney when they are unable to afford one.
