Following the American Revolution, colonists faced the issue of creating a new form of government and order for their newly created country. Delegates from each state, excluding Rhode Island, met in Philidelphia in 1787 to draft the document that would come to be known as the Constitution. Representatives made it their purpose to create a government that would be fair for everyone; the North and South, the educated and uneducated, the rich and poor. After a closer examination of the Articles of Confederation, delegates disregarded the Articles, following the failure of their original form of government. The power of the government was most equally distributed amongst the people, states and central government, decreasing the possibility of tyranny. A stable democracy with its inalienable rights also protected the citizens from losing their rights in the event of the formation fo a tyrannical government. However, the government increased the chances for a tyranny to occur through the elastic clause and Gerrymandering. While the Constitution did include stable democraces, inalienable rights and power divisions, all of which protect against tyranny, Gerrymandering and the Elastic Clause allow for tyranny to occur. The colonists created a system in which the government had limited power but enough to maintain the country while the states and the people received equally limited power as well. The Constitution still protects its citizes on several accounts, including through democracy and power distribution, nevertheless failing in premitting the President to wield all powers during a national emergency. Thus the nation’s leaders came together during the summer of 1787 at the Philadelphia Convention to draft the Constitution of the United States. The constitution was ratified in 1788. The Federalist Party had to gain nine of the thirteen states’ approval of the constitution to ratify it despite the goals of the Declaration of Independance. After the tyranny of the British rule, the new citizens of the United States wanted a severely limited government.
The first constitution of the United States was called the Articles of Confederation, ratified on March 1, 1781. These articles gave supreme power to the states, followed by a weak central government. The central government was unicameral, meaning there was no executive or judicial branch and all federal power came from Congress. Congress was made up of two to seven members per state and each state contributed one vote each. members Congress were appointed by state legislatures and held a term of one year.
Two different views, two different types of people, but both share the same purpose to help the country. The American revolution was successfully won, but the struggle to on how to govern this newborn country was up for debate. The Articles of Confederation were instituted, but soon they proved to be inadequate to govern the United States after the incident with Shay’s rebellion. Shay’s Rebellion was a group composed of farmers and veterans who were overtaxed and the government had not compensated their efforts in the American Revolution. This group planned to overthrow the government by raiding an arsenal, but the state militia from Massachusetts was able to help.
With the knowledge of what a tyranny is, we are now faced with a pressing question about our own government. Does the Constitution guard against tyranny, and if so, how? The Articles of the Confederation was the first government constitution that the United States used, and, although there were strength like the Northwest Ordinance of 1787, there were major weaknesses of the Articles of the Confederation like the following: requiring 9 out of the 13 colonial votes from the representatives from different states to pass a law; having no executive and judicial branch; and the federal government being unable to impose tax revenue onto the states. Such flaws would eventually lead to the Constitution and the repeal of the articles, for the Constitution was a measure to fix the problems of the articles with a stronger government that allowed them to impose taxes and and implement new laws for a more effective government.
