The United States Criminal Justice system has a unique way of approaching and handling criminal trials. In criminal trials there are important court room members with specific roles and certain court room procedures that must be followed. The court room members include the jury, the judge, the prosecution, and the defense. Some of the procedures of a criminal trial are arraignment, preliminary hearing, the trial itself, opening statements, direct examination, cross examination, closing arguments and the verdict. The prosecution represents the state/the victims in criminal trials. A prosecutor’s responsibilities are to be professional, seek justice, and strive for the truth. Prosecutors live up to their responsibilities by gathering evidence, collecting witness testimonies, and obtaining other information to present a case against the defendant. Throughout the movie My Cousin Vinny, Jim Trotter is the prosecuting attorney. In the entire movie he is using evidence and witness testimonies to try to get the jury to find Billy Gambini and Stan Rothenstein guilty of killing the clerk in the store. Board of Education is a very important landmark case. This case addressed the constitutionality of segregation in public schools back in the early 1950s. When the case was heard in a U.S. District Court a three-judge panel ruled in favor of the school boards. The plaintiffs then appealed to the U.S. Supreme Court. The Supreme Court went through all its procedures and eventually decided that “Separate educational facilities are inherently unequal” (). This case was extremely important and made is so children of all races could attend the same schools. This decision affected the Criminal Justice system as well as society as a whole and allows people to live they way they do
Board of Education is the most famous case involving education in American history. The case highlighted the issue of segregation in the school system . The plaintiff Oliver Brown argued that his daughter should be allowed to attend the whites only school. His argument was based around the fact that the whites only school was much closer to their home than the blacks only school.
It must however be noted there would have not been a difference even if the case had been decided on the rounds of a majority opinion[11]. However, the reason as to why the Justices had to advocate for a unanimous decision was because of the fact any dissenting opinion would have resulted in counter-arguments by those who were in support of the segregation aspect. They would have therefore used the dissenting opinion to legitimize their claims and would have jeopardized the efforts that were being made to delegitimize the segregation aspect within the education system. A unanimous decision would have been the best as far as any counterclaim is concerned and would have given the supporters no loophole to counter argue the decision[12]. Before the unanimous decision was made, it was reported that Justices had been seriously divided over whether segregation was beneficial to both races or not.
After a while of being stuck on the decision the court decided to rehear the case at a later time. While waiting for the case to be reheard the chief justice was replaced and when it was time for the hearing of the case the new chief was able to bring everyone to a unanimous decision. After this case was conducted the separate but equal was stripped away in the educational field and equality came slowly along. All the colored signs and white only signs started to disappear in schools and schools started to integrate with all races attending them. Although this case did not change the world overnight this case did over time turn the world around. In the 21st century there are multiple races that attending public schools, and we all use the same equipment.
In the case people were getting desegregated because of their race such as white or black. The Courts did not find it right at all that african americans had to get treated that way and not treat others the same way. For almost 17 years southern border has been segregation ⅔ of them are african americans. Blacks were getting done wrong because of their color or should I say race. Judge Bohanon wanted to end this, so he forced a stop to segregation in Oklahoma City Public Schools through his ruling (1). This shows how government leader like Judge Bohanon would try to stop segregation. With them using the power they had they would start with one small area such as schools and it would get the ball rolling to be able to expand the stop of segregation in other areas. Colleges could no be segregated as of June 6, 1955 because of the ruling by Oklahoma’s Board of Higher Education (8).
