The legal law to have rights at the workplace impacted Bernie because he knew he had a right and it didn’t matter how long it took him, he was going to live by his rights and made sure that he got them. It also made him realise that if others have been injured or have health issues cause by the workplace they need to stop staying quiet about it and speak up Like Bernie Banton used to always say “never take no for an answer”. He knew what his rights were and he knew he was going to keep on fighting for them.

The James Hardie Company would argue that they did not realise the extent of harm asbestos has or could cause, seeing that they assumed this it was unnecessary to inform the workers of the asbestos. Also once symptoms do present themselves; it may take a while to diagnose the illness, also the individual needs to determine that the illness relates to the negligence by a company. The problem for the company that has been negligent is whether it can continue to operate its business. This can be difficult for companies that are in financial distress and cannot pay to compensate. Bernie Banton’s role taking in this case to court was the plaintiff. He had to prove to the courts that the James Hardie Company, the defendants, their company is legally in the wrong and had infringed his rights as a worker in the company at the time. Banton being diagnosed with cancer gave him the motivation to fight against the James Hardie Company, he wanted all Australians to know that they all have human rights and if it is overstepped, to stand up and say something about
