The Fourth Amendment protects American citizens from unlawful searches and seizures. Although, if a government agency has a lawful reason the court will present them with a search warrant. This Amendment protects American Citizens from having their personal property searched by the government without a search warrant. With the Fourth Amendment American citizens feel safe and secure from unlawful searches and seizures. The amendment also prevents worry of government trespassing without a warrant. However, the government could be trying to find a terrorist, for example, and be searching phones and/or emails. Furthermore, the Fourth Amendment guarantees people the right to privacy, makes American Citizens feel safe, and precludes worry about …show more content…
The Fourth Amendment 's permits the government to monitor people who are not even thought to be doing anything wrong (surveillance procedures).Telephone calls and emails could be under surveillance, by the NSA or any other government program (Senate Committee).Documents show NSA conducts sweeping surveillance Americans international communications (Senate Committee). The courts must determine what constitutes a search or seizure under the Fourth Amendment (Fourth Amendment). Therefore, The Fourth Amendment does protect our rights to privacy under searches and seizures. The Fourth Amendment makes people in American feel safe and secure. David Sirota says, “National Intelligence admitted illegal surveillance was still taking place"(understand). Chairmen of the house say "NSA is not listening to calls or monitoring emails" (surveillance procedures). NSA 's, component of defense department is engaged in unconstitutional surveillance of Americans (surveillance procedures). "At any time I could wiretap anyone I wanted” states Edward Snowden
The Fourth Amendment makes people in American feel safe and secure. David Sirota author of “Does the government actually understand the 4th Amendment?” says,"a few years after it aired the director of national Intelligence admitted illegal surveillance was still taking place"(understand). " the Government’s unverified assertion that it has halted “systemic” illegal/unconstitutional surveillance by the National Security Administration." says David Sirota author of “Does the government actually understand the 4th Amendment?”(Understand). Sirota also states "The NSA is admitting that even with an outdated 1997 supreme court ruling it knows it cannot post mass collect metadata with no warrants whatsoever.
Billy is on the phone with Bob while they are talking on the phone and someone coughs and it is neither of them. Well, the government are the only ones who can hack phones and listen to phone calls, the 4th amendment has allowed this to happen. The 4th amendment has gavin the right to law enforcement to be cruel and unfair about a search and seizure. Without a warrant you cannot search a person, well not anymore, the government can search anyone at any time in some scenarios. Normally, there is an abundant amount of evidence used to be given the permission to search one’s belongings, but since 9/11 law enforcement needs little evidence to be provided a search warrant.
The Fourth Amendment: The 4th amendment provides protection in regards to the issuance of warrants sans probable cause and protection against unreasonable searches and seizures. This amendment implements the limit of law enforcement power to conduct searches, seize property, and make arrests. The 4th amendment however does permit searches and seizures when reasonable justification as to why the police need to conduct a search is established. If an individual believes to have a well-founded expectation of privacy of the location or material being searched, the 4th amendment will be upheld. The 4th amendment is classified as the most significant in terms of criminal justice due to the fact police do not violate the fourth amendment by making reasonable mistakes, however, intentional ignorance of the law is not excused.
The Fourth Amendment requires a probable cause for arrest. Substantially, particular things are needed to legally conduct a search or seizure. This incorporates arrest, so a search, a seizure, or an arrest cannot take place without reason. Not to mention, there must be a "court order" for Apple to give the government "customer data." So, since a “court order” must be in place for Apple to give the government “customer data,” that “court order” would have to also take place for an arrest that could conceivably follow.
Our founding fathers created the Bill Of Rights which are the first ten amendments to the Constitution of the United States. One of the most important amendments is the Fourth Amendment. It states “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”(p. 11). What are our founding fathers were trying to do is keep our country from a police state, a state in which law enforcement could enter our homes without probable cause. This protection provides the citizens of the
The PATRIOT Act violates Fourth Amendment: the right to an unlaw search and seizure, and because phone records are recorded without the knowledge of any American it violates the amendment. By secretly recording all phone calls the civil rights of all Americans are being restricted and denied. The government is way over-stepping their boundaries with the PATRIOT Act. Civil rights are of the most importance to every American and it is not something the government has any obligation to intrude upon. The FBI and the NSA break the law by recording the phone calls.
Espionage and the Fourth Amendment are not compatible especially when people get accused for no legitimate reason. After the September 11 terrorist attack on the Twin Towers in New York. George W. Bush issued more policies to expand espionage agencies to ensure that future terrorist attacks can be prevented. Some people might argue that “preventing the loss of American lives requires some restriction of civil liberties” but other people say that “the war on terrorism is different from traditional wars and thus requires that government officials exercise special care to maintain civil liberties” (Espionage and Intelligence Gathering 114). Having civil liberties is one of the few rights that American citizens can have.
The patriot act has in my opion violated the 4th amendment. It has its advantages as far as terrorizim but to normal citzens this is a complete violation of our privacy. bThe late Benjermin Franklin warned us about trading our liberty for sucureity. This act has taken away a lot of our liberties it gives the government way too much power to invade our privacy. They now have unprecedented power to monitor the phone calls, e-mails, without a warrant.
To begin, we need to understand the fourth amendment. The fourth amendment was created to prevent the government from breaching into our homes and convicting us of crimes based on evidence they discover within our homes. It was vital to state unreasonable searches in the constitution, and an unreasonable search is a search done without
The whole point of the Fourth Amendment is not to completely stop the police, because the amendment can be waived if an officer has a warrant, or a person’s consent. The Fourth Amendment states that generally a search or seizure is illegal unless there is a warrant, or special circumstances. Technically stating that a citizen is protected by the Fourth Amendment, until a government employee gets a warrant, and then they can invade a citizen’s privacy. Also people state that the FISA Court’s warrants are constitutional, but the NSA’s surveillance is unconstitutional. Even though people do not like the NSA’s surveillance, the NSA is legal because the FISA Court that the people did not mind makes it legal.
Based on an article written in the official website of Cornell University Law School titled “Fourth Amendment: An Overview” states that: "[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation" (LII Staff). The Constitution, through the Fourth Amendment, shield's individuals from nonsensical pursuits and seizures by the government. The Fourth Amendment, in any case, is not a certification against all ventures and seizures, but rather just those that are regarded outlandish under the law. This is a great example for people who blame the government for allowing parent to implant microchips in their children.
The fourth amendment can be beneficial but, it can also to some U.S. citizens be invasion of privacy. The fourth amendment states “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated,” some U.S. citizens believe that Law Enforcement, the Government and the NSA are violating the required guidelines of the Fourth Amendment. The NSA is conducted a mass U.S. surveillance not to believe specific individuals may be engaging in terrorist activity, but instead to believe all of us may be engaging in such activity. The government mass surveillance proves that U.S. citizens are considered suspects at all times. With the Patriot Act the NSA has access to
The Fourth Amendment provides defense against illegal search and seizures. Essentially, one can rest assured that the police will not simply enter his house without any cause or warrant, search until they find something incriminating, and then legally use that discovery to charge the person with a crime. Instead, there are many very specific rules and regulations about how something can be discovered and even damning evidence found incorrectly is thrown out (Katsh, 2013). This is an important constitutional right as it ensures that witch-hunts that aim specifically to find something illegal are never carried out and instead the law enforcement aim is to properly catch someone who is doing something wrong.
Is war really a battle fought between two nations or more? The oxford definition of war is a state of armed conflict between different nations or states or different groups within a nation or state. In relation to war, racial profiling can be seen as an undeclared war. An undeclared war is a term used for disagreement fought without an official declaration. The undeclared war between male minorities and police forces is a constant issue that is being surpassed in our society.
And finally, they have a program that records every phone call made, and stores it for a month. The evidence is overwhelming: privacy is a right, since it is one of the mayor topics of the Bill Of Rights. The NSA has been using spying programs on Americans and others overseas. The American government has abused its known and unknown capabilities.
