Leonard Peltier’s Innocence Leonard Peltier was a Native American man arrested for supposedly killing two FBI agents on Pine Ridge Reservation of South Dakota. There have been many debates about the integrity of the court cases and the lawfulness of Peltier’s arrest. Many FBI supporters would claim that there were eyewitness accounts and various other pieces of material evidence that show that Peltier was the culprit. However, Peltier supporters would rebut the evidence, saying that the eyewitness accounts aren’t legitimate and the court decision was politically influenced. I will consider both sides of the argument, and show that Peltier’s innocence is evident because the evidence provided against Peltier was falsified and the FBI used disingenuous methods in charging Peltier for murder. …show more content…
The burden of proof is on the side making the positive claim. Probable cause must exist for a legal arrest. Additionally, the positive claim that Leonard Peltier murdered two officers, puts the burden of proof on his accusers, namely the FBI. In more familiar terms, Peltier is innocent until proven guilty. The pro-Peltier side simply has to refute the evidence of their opponents to prove Peltier’s legal innocence. It is true that Peltier isn’t beyond criticism; his alibis on several different occasions have slight inconsistencies and he defends the murderer of the agents, whomever that is (No Parole Peltier Association). However, using this to call Peltier a murderer would be a blatant use of argumentum ad logicam. No matter how much Peltier lies, it does not follow that his conclusion is wrong. Thus, unless the faulty alibis can be used to show evidence that he is the murderer, all they prove is that he told lies. The case of Mapp vs. Ohio is a case of illegal search and seizure. It went to the Supreme Court in 1961. It is important to today’s society because it might mean the difference between guilty and innocent. I agree with the Supreme Court because it is illegal to access private property without a warrant or consent. The case lasted until June 19, 1961.

The first is that it covered the potential acts of good faith in the police officer, and how the evidence that was claimed to not be stored properly. The defendant blamed the officer and thought they should be accountable for the length of Youngblood’s sentences. Back in 1975, there was a major case called, Payton V. New York. Theodore Payton was suspected of murdering a gas station manager, they found evidence within his home that connected him with the crime. What caused the problem was the fact New York had a law that allowed unwarranted searches if the person was a suspect. Based off the oral argument presented by Oyez, the police said it didn't count as the evidence because it was in public view when entering the home. It had to be appealed before it was determined as unconstitutional.

A custodian found Robert Flake laying on the ground in the performance arts center with stab wounds all over his body. Robert Flake 35 years old, 5”10, and 270 pounds, was taken to Memorial Hospital located at 4500 Memorial Dr, Belleville, IL 62226. Robert Flake was reported dead Monday night October 3rd, time was not given. Robert Flake died of his stab wounds.
In 1892, a young woman named Lizzie Borden was accused of murdering her father and stepmother (“Lizzie Borden on Trial” 2). This accusation was influenced by the lack of evidence at the scene of the crime. There appeared to be no murder weapon, very few witnesses, and the house did not show any signs of an intruder (“Lizzie Borden on Trial” 5). Once the scene was investigated, it was determined that the cause of death for both victims was multiple blows to the head by an axe. Two axes were found in the home, and neither had a speck of blood (“Lizzie Borden on Trial” 14).

There are those who feel that the moment that one is arrested, there is reasonable belief that they committed the crime.
