Persuasive Dress Code

Part 1: Bluebook Citations and Summaries • Tinker v. Des Moines Indep. Cmty. School Dist., S. Ct. 503 (U.S. 1969) - In this case, John F. Tinker (age 15 years old), his younger sister Mary Beth Tinker (age 13 years old) and Christopher Eckhardt (age 16 years old) wore black arm bands to school to display their non-support of Vietnam hostilities.

In the past students did not know the guidelines of what they could say at school,but the students at Des Moines brought attention to the rights of every student at school(Blacher 10). Things changed in the 1960's many students wore black armbands to school as a way of protesting the Vietnam War (Blacher 11).The Des Moines school banned them from wearing their armbands(“Case summary:Tinker”1). Mary Beth and John Tinker believed it was their constitutional right to be able to express how they feel(“Case summary:Tinker”1). They decided to take their case to the courts. case went all the way to the supreme court(“Case summary:Tinker”1).

This case Tinker v. Des Moines Schools was a very interesting case argued in 1968. A lawsuit was filed against the school after three students, Two of which in high school and one in middle school were suspended from school. The school suspended the students for wearing black armbands protesting the Vietnam war. Two other students wore armbands, but were in elementary school and weren't suspended. The students were fifteen year old John Tinker, sixteen year old Christopher Eckhardt, and thirteen year old Mary Beth Tinker.

Citation: Tinker v. Des Moines Independent School District (1969) Facts: In Des Moines, Iowa, a group of individuals met at a home to discuss ways to protest the United States involvement in the Vietnam War. The group decided beginning on December 16th and lasting until New Year’s Day, the members of the group would fast and wear black armbands to show their opposition to the war. School officials became aware of the students’ protest and implemented a policy that any student wearing a black armband would be asked to remove it. If the students did not remove the armband, then the student would be suspended.

A landmark Supreme Court case known as Tinker v. Des Moines was argued on November 12, 1968 and decided on February 24, 1969. The parties involved in the case where the plaintiff, the Tinker family and the defendant, the Des Moines Independent Community School District located in Des Moines, Iowa. The issue or focus of the case was the extent of the first amendment to students on school grounds and whether or not the school district acted in accordance to the constitution when prohibiting the use of armbands as a symbol of speech. Petitioner John F. Tinker, his sister, Mary Beth Tinker, and his friend, Christopher Eckhardt, attended public schools in Des Moines, Iowa where they wore black armbands as a symbol of protest against the government’s policy or involvement in the Vietnam War. The Des Moines School District had become aware of the planned protest and created a policy against it on the 14th of December.

The Tinkers tries to fight the suspension with the district court but the district court was in favor with the school so the Thinkers had to take it further. Des Moines ruling based off of the Court of Appeals reliance on the case in ruling on Bethel v. Fraser. Essentially Tinker v. Des Moines hinges on whether the school acted in accordance to their authority to maintain a proper environment for students, by impeding Tinker’s Right to Freedom of Speech. The Court found that wearing a black armband in peaceful protest is protected under Freedom of Speech, because there was no disruption caused in the action, it was unnecessary for the school to react in the manner that it did. Justice Burger went on to suggest that the Court of Appeals missed the mark in comparing the two cases.

The Tinker versus Des Moines court case involved three minors, John Tinker, Mary Beth Tinker and Christopher Eckhart. These three wore black armbands to their schools to protest the Vietnam War and were suspended following this action. Circuit courts and the Court of Appeals in Iowa ruled that the black armbands were inappropriate attire for school. This case was then brought to a higher-up court. Eventually, this case was brought before the Supreme Court.

School Dress Code is Sexist School dress code has gotten out of hand, limiting young girls and boys on what they can wear to school. Telling young women that they are distractions in class because of what they wear. Girls get sent home because of their outfits it makes it seem like the administration is not worried about whether or not they get an education. Many types of clothing d or that have such as leggings, low cut shirts, and shorts have been banned or have restrictions. It is hard to find clothes that meet all these requirements.

Being able to choose what to wear is a right students are allowed to have, but schools are constantly trying to change that. Religious wear is not being accepted as part of the dress code causing problems between the school and the student whose identity is being taken away from them along with the boy who could not stand trying to be like everyone and ended his own life. Down to the basic right as a human to experience life just as anyone else has. There are many more reason as to why schools should allow students to dress how they want to, but these three reasons provide all of the points needed. Overall, schools should get rid of the dress codes enforced and allow the students to explore their

Recently, more and more schools all over the country have turned to dress codes. Some people say that dress codes teach professionalism and protect students. However, schools should not have dress codes because dress codes target girls and limit their freedom of expression. They also are hard to enforce and students break them anyways. Dress Code When it comes to the topic of dress code there are many controversial factors that come to mind such as While some argue that dress code is necessary in order to properly teach students to dress appropriately, others contend that dress code infringes on students individuality and creativity. This is not to say that there are some people whose feelings land in the gray area in between. In recent discussion of dress code, a common question has been whether dress code is fair or not fair among all students. On the one hand we have parents, young women, and other members of society who argue that some schools take dress code too far.

Over the last 20 years, many schools have shifted away from fairly unregulated student dress codes to more stringent dress codes, with some schools implementing voluntary or mandatory school uniforms. There are several positions on the dress code issue, each of which have their own persuasive arguments to support them, which can be evaluated to examine their validity. One position in favor of implementing dress codes is that these standards can improve student safety and perhaps even student performance at school. There are variations on this position that favor strict standards on what students can wear, while others want to implement school uniforms in public schools. The opposing view is that students should not be subject to any dress codes on the grounds that they restrict students' freedom of expression, and that they may place unfair cost burdens on poor families.

2017 has been a year supporting female empowerment, expression, and confidence with your body. So why should girls feel ashamed of their bodies in the environment where they should feel the safest? The dress code should be less restrictive because, it’s unfairly targeted at females, it makes women feel less confident, and it restricts most athletic clothing made for girls. Schools continually enforce rules that they’ve had since they were founded. Times change, and rules need to too.

Many high schools have implemented dress codes that set rules for what students can and cannot wear while on school premises, and yet many people disagree with these policies. Though arguments can be made for either side, a dress code can have a very positive outcome for all parties involved. A fixed dress code promotes professionalism in a learning environment, and contrary to popular belief, it does not limit a student’s freedom of expression. Last but not least it encourages equality and acceptance among their peers. A dress code can be reasonable if used in proper situations that require certain attires.
