Overtime in history, the United States has developed documents from the Puritans idea of Covenant to what we have today-The Constitution of the United States. The Puritans eventually escaped to freedom in America from England and then later, helped show colonists through experience and history how to develop certain parts of The Constitution. Most events leading up to writing The Constitution, have parts in it that fixes problems of specific events so that if another event similar to the one prior happens, the United States would already know one solution. Throughout U.S. history, there have been people and their cultures expand during and after the Puritans idea of Covenant, such as the Quakers, the Pilgrims, and the colonists. For the most part, the United States has abided by these rules, but there were times that the U.S. did not. For example, times of slavery, was not only brutal, but unconstitutional. In document A, in “Slave Interviews”, William Colbert is being interviewed on his perspective of slavery by John Morgan. William Colbert states, ““January, he neber said nothin', and de massa keep a beatin' till little streams of blood started flowin' down January's chest, but he neber holler.”” William Colbert experienced the brutality of slavery. The act of the lashings and beatings were unconstitutional because the government did not protect these slave’s natural rights of life, liberty, and the pursuit of happiness. The government’s main role is to protect one’s natural rights, and since the government didn’t protect these slave’s natural rights, then the government did not fulfill its duties. This is just one of the many times that the United States has not always abided by the Constitutional laws. Power in political parties is also one of the many examples of when the United States hasn’t always abided by the Constitutional laws. Political parties have separated the country and has caused friction between people just when the topic of politics comes up. In the government, depending on the president’s beliefs or the majority of the houses, one political party …show more content…
For example, slavery was unconstitutional because the government did not protect those slaves’ natural rights, economic interests versus the government protecting our natural rights, and political parties causing friction between people in the U.S. All of these factors could reoccur and are still happening to this day. Unfortunately these situations were not handled in the right way-because the United States government has let the country go on for so long like this. Though some situations can be forgotten, these situation could not and will not be. Overall, America does not always follow the Constitutional laws. Past events like slavery and political parties prove that the U.S. hasn’t always abided by the Constitutional laws. The Constitution is not always followed by people with different beliefs, but the United States can typically count on The Constitution to help line up almost any problems that may
The constitution of the United States is an insightful and revolutionary idea of how a government should be practiced in order to prevent a greedy, corrupt form of government from establishing and taking over its people. The US government is founded on the principle that it works for its people, meaning that whatever is legislated is meant only for the benefit of the American people. However, the Constitution is at this point flawed due to the fact that many of its proclamations are vague and outdated, and has to be left to interpretation as to what the framers truly intended of it. This is dangerous because it further divides the nation when Americans believe in different forms of what is constitutionally righteous, and this may start a civil
When our country’s founding fathers first came together, they disagreed on many things. However, there was one thing they all agreed on. They had to protect against tyranny. Tyranny is when a person or a group of people, deny rights to another group of people. For examples, Britain taxed the colonies without their representation, which took away some key unalienable rights, which are rights that everyone is entitled to.
On the off chance that the Supreme Court did not set up translations of the Constitution when choosing on the off chance that they ought to topple an elected law, then there would be no positive understanding in the national government with reference to how certain parts of the Constitution ought to be seen. The Constitution is frequently thought to be the standard that all laws ought to conform to. On the off chance that there was no clear elucidation to the Constitution on a government level, than it would be troublesome for individuals from Congress to attempt to make laws that agree to the Constitution if there is no distinct intending to the Constitution's rights. Likewise, individuals from Congress may attempt to contend that the Constitution ought to be translated certainly just to guarantee that a law they support can get passed. There are a few individuals who might contend that if only one branch of government has the ability to decide how the Constitution ought to be translated, then this branch would turn out to be too effective.
The Constitution of the United States was written in 1787, but there was a grapple for its ratification that went on until about two decades after the ratification. Members of Congress believed that the first government of the United States or the Articles of Confederation, needed to be adjusted while others did not want anything to change. After the Revolutionary War, the people did not want a strong central government, because it reminded them too much of what they were trying to escape from. Under the Articles, each state had their own laws, and the need for a new Constitution was desired by many. The Constitution of 1787 created huge debates, arguments and splits in the nation that lasted for several year after its ratification between people who
The United States Constitution of 1787 was created in order to build a strong infrastructure for our country to pave a pathway for the future people in charge of the law. The topic in which the constitution was pro slavery or anti slavery was highly controversial for a number of reasons. This topic put the government into many debates though its constitutional convention as the word slavery itself was never said in the actual document. Even Though it was not said, it was clear that the ones in power were biased toward the slave owners in the country based on the provisions that were made. It may be debated as something in between as nothing was explicitly stated, but the three-fifths compromise stating that enslaved persons were not three fifths
Previously, the colonists had problems with a faulty government and feared tyranny. When the colonists first had the opportunity to self-govern, The Articles of Confederation was formed and thus a poor example of government. The Articles of Confederation creating a weak, defenceless and powerless country. In the second attempt to create a more perfect government, the Constitution of the United States of America was formed. The colonists decided to place a guard against tyranny and thus, over 230 years after the writing of the Constitution of the United States, The Constitution in fact protects the states, the states rights and the citizens rights against tyranny.
The American government that we know today, had many troubles when it first came together when the Constitution was first ratified in 1788. There had been many failed attempts at creating a new and successful government, such as the Articles of Confederation the first plan for the new American government. This proved to be very unsuccessful because the states held all federal power, while the national government had very little. In order to please both the Federalists and the Anti-Federalist, each party agreed to the Constitution with the addition of the Bill of Rights. Documents like the Virginia Declaration of Rights, the Declaration of Independence, and the above documents are heavily influenced by the writings of John Locke, Baron de Montesquieu,
The Constitution shaped America into who we are today. It started with the Articles of Confederation. The Articles of Confederation was “the nation’s first constitution and was written to create a firm league of friendship between the thirteen states”(Crouse, Slide 5). Eleven years after the Declaration of Independence was adopted, the United States Constitution was created(Weatherman). After the United States finally won their independence from Great Britain, they spent their early years governed by the Articles of Confederation.
There are two types of different constitutions, loose and strict. Personally, I prefer to have a loose constitution. The first stated constitution is called a strict constitution. A strict constitution is meant to be taken word for word. There is no mediating between two different points, if the constitution doesn’t say you can do it, DON’T!
The Bill of Rights are the first ten amendments in our Constitution which protect our fundamental rights and ensure a limited government. In 1868 the 14th Amendment was added, which guarantees citizens equal protection under the law and due process. For the Bill of Rights to be effective it would have to protect everyone rights equally, but there are too many cases when minorities or anyone else’s rights are infringed. Therefore the Bill of Rights and 14th Amendment is ineffective and does not protect the rights of all citizens. Someone’s race, gender, and religion could all affect how they are treated.
DBQ Essay The United States Constitution is a document that or founding fathers made in order to replace the failing Articles of Confederation (A of C). Under the Constitution, the current government and states don’t have the problems they faced when the A of C was in action. The Constitution was created in 1788, and held an idea that the whole nation was nervous about. This idea was a strong national government, and the Federalist assured the people that this new government would work. The framers of the Constitution decided to give more power to the Federal government rather than the state governments because the A of C had many problems, there was a need for the layout of new government, rights, and laws, and there was a need for the Federal
