On 12/20/2015 at 00:41 hours, while traveling southbound on Hurffville Road, I observed a Black Ford bearing NJ Z47CSR failing to maintain lane. The vehicle was swerving to the left over the center lane. I activated my overhead lights and sirens and conducted the motor vehicle stop on Rte. 42, mile marker 11.7. 2. WHEN STOPPED I approached the driver’s side window of the vehicle and spoke to the driver, Denim P. Dyczok. As I asked Denim for his credentials, I could immediately smell an odor of an alcoholic beverage emanating from the interior of the vehicle. I then could observe his hands to be slow as he was retrieving his documents. As I was speaking with him, he had to stop gathering his documents to answer my questions showing me his was unable to divide his attention. I could also observe that his eyes were watery and bloodshot. I then requested him to step out of the vehicle so I could determine if he was safely able to drive his vehicle. As Denim was speaking to me, I could also smell an odor of an alcoholic beverage emanating from his breath while he was exiting his vehicle. I advised Denim I was going to administer SFST’s. I had Denim stand with his right foot in front of his left with both arms down by his side. I then asked if he had any medical conditions that would prevent him from completing the test, which he replied, “No, I do not.” I then explained and demonstrated the test while Denim was in the starting position. During my demonstrating, Denim fell out of the starting positon once. After I completed the demonstrating, I advised him that he could begin. Denim began the test and failed to touch heel to toe on steps four (4) and five). Denim also raised his arms using them for balance on the same steps. Driver 1 was traveling westbound on Interstate 70 approaching the rear of Driver 2 patrol vehicle. While Driver 1 was attempting to merge into another lane he side swiped the diver’s mirror of Driver 2 vehicle. All parties stated they were not

I observed two (2) clues in total. Sanabria was placed into custody at 0216 hours and he was transported to the Cicero Police Lock-up to be processed. I conducted a search of the vehicle for any signs of alcohol use and observed a can of Monaco alcoholic beverage underneath the passenger seat. Two (2) photos were taken on the scene and later placed into inventory. The vehicle was towed by Tuff Towing (15-3177) and D.U.I. impound packet was completed on the vehicle.
Peter Plaintiff was dressed in very dark attire and wearing a black baseball cap. Peter Plaintiff was walking on the sidewalk of this dark street and texting at the same time. Without looking up from his phone Peter Plaintiff stepped off of the sidewalk, into the bike path, with the intentions of crossing the street. Peter Plaintiff, also a student at UCSB, knows how many people bike in Isla Vista on a daily basis. Peter Plaintiff was not paying attention when he stepped into the bike path and Jack was unable to avoid the collision at that point.

The officer confiscated all of his belongings including his phone. Due to his and Amelia's alcohol percentage being twice the legal limit the officer had the rights to search anything confiscated. Liam got a lecture while some officers took their time searching his phone. Liam had to sit through multiple facts from the officers. Five of them being “excessive drinking is responsible for more than 4,300 deaths among underage youth each year, and cost the U.S. $24 billion in economic costs in 2010, On average, underage drinkers consume more drinks per drinking occasion than adult drinkers, In 2010, there were approximately 189,000 emergency rooms visits by persons under age 21 for injuries and other conditions linked to alcohol, Kids aged from twelve to twenty say that about 18% binge drank in the past thirty days, and 33% drank some amount of alcohol.8% drove after drinking alcohol.20% rode with a driver who had been drinking alcohol”.
On 09-17-16 at 2046 hours Officer Harrell #3441 and I were traveling south on Lincoln Avenue approaching Washington Boulevard. We were flagged down by an anonymous female Hispanic who was traveling northbound on Lincoln Avenue from Washington Boulevard. The female advised she was following a tan pickup truck westbound on Washington Boulevard approaching Lincoln Avenue.
Once officers determined the truck belonged to Espinosa-Flores they performed a field sobriety test, which he failed, revealing his BAC was twice the legal limit of .08 at .160. In police custody, Espinosa-Flores confessed, “he knew he had crashed, but didn't know what kind of car he hit, and said he got out of his truck because he felt like he was on fire. He said he ran from the crash scene without checking on anyone else involved fled the scene of the crime because he felt like he was on fire.”
I find based on a preponderance of the evidence that 1LT Handelman knowingly acted in direct violation of General Order #1, the USFK curfew policy, and a direct order from his Company Commander (give at the safety brief two days prior to the incident) by consuming in excess of 12 alcoholic beverages and being arrested at 0134 hours on 13 Mar 16. 1LT Handelman freely admits to these violations and accepts full responsibility for his actions.
