Goldman Sachs: Power and Peril I am strongly agree with the action of SEC. The main problem of any financial and banking firm is Asymmetric Information (Adverse Selection and Moral Hazard). Adverse Selection is the risk before the money transaction while Moral Hazard is risk after money transaction. But before going directly into subject, we will understand the element involve in the case. The main role of SEC is to ensure that the stock markets operate in such a direction that it will create fair atmosphere for all investors. He had given the information to ACA that Paulson is interested in Collateral Selection process but in real the interest was different. These whole things misled the process. Further GS didn’t announce the participation of Paulson. It was a game made by Paulson. But he used the ground of Goldman Sachs. And so that Goldman Sachs had to know about the game of Paulson. And if any financial institute served as both, seller and buyer, there is always a conflict of interest. If there is high profit from one side then that institute always made partiality. And this is not right thing. And last thing is truth and transparency. Goldman Sachs assumed that IBK is the banking institute and they have all knowledge about the market risk and it was sophisticated investor. The wall street crash in October 1929 was one of the main causes, when the stock markets crashed. This forced many of the banks to close, due to them investing their client’s savings in the stock market.

People were borrowing a great deal of money from banks to invest on purchasing lands, fixing roads, building houses, and buying houses. Even though people did not have enough money to repay their loans, they continued to borrow more, because of low tax returns. People believed that if they waited longer to invest, prices and interest rates will increase.

The Glass-Steagal Act and the Emergency Banking Act signaled a shift from a lassiez faire approach to the banking industry to one that ensured banks were making responsible loans and not gambling with depositor’s savings in the stock market. By not allowing banks who were considered “irresponsible’ to reopen and separating the savings and investment functions of the banks, a more secure system began to emerge. The impact of this legislation was immediate, as bank failures dropped dramatically. Additionally, major breakdowns in the banking industry were avoided until fairly recently, which came as a result of the repeal of Glass-Steagal.

The value of stocks plummeted $14 billion dollars, also known as “Black Tuesday.” There were many causes of the Great Depression such as, unhealthy corporate and banking structures, unsound foreign trade policy (Hawley- Smoot Tariff Act), economic misinformation, unequal distribution of income, and supply-side economics. Capitalism did not self-reform and was not a dependable system for majority of people.

Most frauds that were occurring before the implementation of the SOX-2002, had top management such as in Cendant that didn’t have care for the ethical performances as much as in today’s corporate world with more regulations in hand by the government.
