Nicole’s Murder According to Simpson & Haven, the murder of Nicole Simpson and Ron Goldman was a shock to the nation, but what was more appalling is the fact that O.J. Simpson was the one on trial for those murders. The authorities were more concerned of the victims’ rights were being neglected (Simpson & Haven, 2008). This paper will expose Nicole Simpson first time reporting intimate violence to the authorities long before her death. I will also examine stalking and intimate violence, victim rights as well as protection provided by the regulation and how it pertains to the case of Nicole Simpson. In addition to the connection in homicide, intimate violence and stalking. Particularly, the case of Nicole Simpson. The theories of criminology …show more content…
The available services for victims are provided on a case to case basis. Training is also provided for staff members that are handling domestic violence cases and simplify compensation collection or resolution between the lawbreaker and the suspect. In reference to Simpson case, victims’ rights were severely violated. Nicole Simpson was neglected of her victim’s rights; she was not given protection nor a police escort after she filed a complaint of intimate violence. The accused O.J. Simpson should have been given a restraining order to protect Nicole, there were still access to her even after she made a complaint of intimate violence. Changes have to be made for the future, police that is handling cases such as intimate violence should have a prompt response. The restraining order wouldn’t do any good if it isn’t enforced, the perpetrator should be return to police custody to guarantee the safety of the victim. Compensation can be used as a tool to discourage offenders from committing acts. Families and victims should be compensated for the grief that they were put through and the losses they may have had (Fattah & Peters, …show more content…
There is a checklist that police officers must abided by so that suicide and homicide will not become a possibility in these domestic cases. Each case is different however, the measure of prevention is the same. The danger in the Case of Nicole Simpson was not seen as a threat by authorities, if it had then she would have been protected. She made numerous of statements about being abused by her husband O.J. Simpson, there were also statements made to her friends but nothing was done. The authorities are just as guilty as the murder, due to their negligence they should be held equally responsible (Newburn, 2007). Five questions that would have been relevant to ask victims in dangerous intimate relationships are:
1. Have you ever been threatened with a weapon by your abuser?
2. Have you ever been threatened to be killed by your abuser?
3. Is your abuser capable of killing you?
4. Have you ever been choked by your abuser until you blacked out?
5. Can your partner gain access or does he own a weapon?
Lastly, the case of Nicole Simpson will never be truly put to rest. O.J. Simpson was never deemed innocent nor guilty so that leave such a gap in the legal system. The hardest part of this case is that the police failed to take preventive measures to assure Nicole’s safety after she reported said
However, there are several strategies that law enforcement can use to help prevent domestic violence-related homicides, including: Risk Assessment can use risk assessment tools to evaluate the level of danger faced by victims of domestic violence. These assessments consider factors such as the history of violence, access to weapons, and the abuser's behavior to determine the level of risk. By identifying victims who are at high risk, police can provide more targeted support and resources to prevent further violence. Mandatory Arrest Policy jurisdictions have implemented mandatory arrest policies in cases of domestic violence, which require police officers to arrest a suspect when they have probable cause to believe that a domestic violence crime has occurred.
Not only is the victim at risk of death, but there are direct correlations to child deaths during the admission of the parent homicide and/or as a form of retaliation. Frequently child welfare is involved in
The JonBenet Ramsey case was a case that garnered nationwide attention. To still be unsolved to this day, shows for one, that the investigation was not conducted properly. Who could have killed the six year old beauty queen? Questions surrounding the case remain to this day, nearly 20 years after her death.
Crime victims like Lucia and Rosalvas play an important role in the criminal court system. “Beyond the need for victim cooperation to successfully prosecute many crimes, the courts and the people that work in them have a moral obligation to treat victims with respect and dignity. (Craig Hemmens, 2017)” Lucia Garcia in my opinion did not help the case, because she kept stating that the incident that took place was an accident and that it was her own fault. Although Rosalvas Sandoval stated that her was in fear of her own life when Mr. Garcia attempted to carjack her brothers truck when she was sitting on the passenger side. One victim in my opinion helped the case against Alfred Garcia, when one victim stood beside the defendant during the length of the
Second, the post crisis victim needs must be met. This includes the first responders’ needs at the time of the incident and their mental health needs afterwards. Third, victims’ rights and services must be provided during the criminal justice process. This is taking into the consideration of the victims and their rights to see the judicial proceedings carried out.
It was because of Simpson's defense team, the jury rendered Simpson as not guilty; there was reasonable doubt in the DNA evidence in the case, and racial afflictions present. Methods, Investigation, and Indictment Simpson was recently divorced from Nicole and had a history of physical abuse and jealousy issues. In the trial Darden told the jurors, "If he couldn't have her, he didn't want anybody else to have her" (Linder, 2000). Simpson was over possessive, and was an extremist. There were numerous incidents that Simpson went to the extreme, in a call Nicole dialed to 911 in Oct. 25 1993, she said “My ex-husband has just broken into my house and he's ranting and raving outside the
On June 12th, 1994, Nicole Brown Simpson and her friend Ronald Goldman were found knifed to death outside of her home in the wealthy Los Angeles town of Brentwood. Suspicion quickly focused on Simpson. He had beaten and threatened his former wife in the past. The police reported that they found a blood-covered sock and glove at his house. He had a gash on his hand.
In the case of Tara Brown’s murder, various groups of individuals are affected. As well as maintaining principles of fair punishment and deterrence, the criminal justice system has to consider perceptions of the victim’s family (secondary victim), the community’s demand for crime prevention, and the offender’s rights to a fair court hearing. The most likely outcome is imprisonment for Lionel John Patea due to committing an indictable offence. It is important to note that if this was only a case of domestic abuse without murder, it would utilise more time, effort and expenses to come to a resolution. This is due to the different circumstances and degree of abuse that the judge has to assess.
Results from the interviewing the justice members and the community stakeholder showed positive responses. Several showed a concern with the process being lengthy, not offering good enough treatments for the mental health, no help with financial issues and lack of communication between criminal and domestic violence courts which can affect the decision and be a risk to a victim. One positive outcome that has been proven by domestic violence courts is having a peace bond. There is a decrease in the number of trials showing that accused are willing to take advantage of the treatments they are being offered
Megan Reese Argumentation and Persuasion Paper III Why O.J Got Away with Murder: A Murray Ogborn Application Physical evidence, DNA proof, and a violent past history could seal the fate of OJ Simpson in the controversial murder trial of his wife Nicole Brown. Although so much damming evidence pointed that he was the murderer, on October 3rd 1995 a jury reached the verdict of not guilty. How does a murderer get away with murder when there is a vast amount of scientific evidence and testimonials presented to a jury? Murray Ogborn, a redound trial lawyer, would argue that the District Attorney (D.A) did not tell the right story, and thus the jury could not remember or relate to all the factual evidence presented during the 9
The power and control wheel, a tool used when trying to educate victims of IPV, is symbolically represented throughout the book by demonstrating how these abusers keep control of their partners. This wheel details eight forms of violence that abusers commonly use to keep control over their partner, that include, using male privilege and coercion and threats to maintain dominance (Burgess et al., 2012, p. 300). Victimology also studies, the effects such patterns of abuse have on an individual, such as learned helplessness and PTSD (Burgess et al., 2012, p. 300). Furthermore, it is grounded in the approaches and steps of action to take in order to help victims of trauma and
To determine the effectiveness of no drop prosecution policies in stopping domestic violence, it is crucial to understand how no drop policies work, the role of the victim in the proceedings of a no drop prosecution trial, the role of the accused in a no drop prosecution trial and the overall comparison of no drop prosecution trials compared to other police policies and legislation in reference to domestic violence. In order to understand whether or not no-drop policies are effective, it is necessary to examine the basic information regarding these types of policies, determine what is involved in the process of no-drop cases and the effects that these cases have on both the legal system and the participants in the case. Generally defined,
Otherwise, I would be only adding to the issue and deepen the negative health impact of intimate violence’s victim. I also may communicate in open talk, provide references to support groups and access to shelter, and psychological
First, offenders are to take responsibility and accountability for their actions and responds to the damage they’ve caused the victim(s). The offender must then act to ‘repair the damage’ this may include letters of apology, restitution, or community service. Next, victim-offender mediation programs involve the competency of the offender. This means the offender’s ability to function as a dynamic and fully capable citizen – this is related to inducing empathy in offenders, teaching them both communication and conflict resolution skills. Lastly, public safety includes having new relationships between the community, offender, and the victim.
Victim witness programs are used by the government in order to provide support and assistance to those who fall victim to a crime. According to Victim Witness Program, the primary goals of such programs, include but are not limited to, encouraging victims to participate in any parole and supervised release processes of their offender, notify and facilitate victims in participation of any hearing or release dates in regards to their offender, provide options for supportive services, and advocate for crime victims (2015, para.1). The organization under which the victim-witness program is located is under a system, which has many internal constituencies, thus creating competing and conflicting purposes. The goals of the victim-witness program are quite simple and seek out to give the victim the right to be represented during the processing of the offender, however, given the multiple roles the court, for example, must serve, the goals of the victim-witness program can be both complex and conflicting.
